This would be considered technically a non-criminal hate crime because it's not physical violence. However the issue of theft. the issue of a certain group being targeted for a purpose to impoverish the black community now, I know it's not what you want to take on. but see any time you can keep on giving statistics about black and brown black and brown and keep using black people as your justification for doing what you're doing for Hispanics, then surely you have to pay attention to what our problems actually are as uncomfortable as that may be for you just like is might be very uncomfortable for the black Alderman here and all the women here to take on such a task. But it's come to that now. It's come to that because you cannot sit back and continuously watch our properties getting taken from us. Illegally, then when we do the right thing and take the issues to court to fight then in court our violation our civil rights get violated. So what do we do? Because for me I know for a fact hands down no 1 is going to come and take my property from me that men in my family for 61 years and been paid for. Since I was a teenager. just because the city of Chicago feel like they want to engage in Theft now I get off the Metro rank train and I see how Hispanics are Paran. They Paran they got housing. They ain't worried about a thing. But here I am a black person. with a legitimate right problem and I got to fight for somewhere to live and I've been living in this country for 61 years. My name is Brian O'Donnell and I am here on the homeownership bureau in the Department of Housing. President in the gallery today from bicker die Redevelopment Corp, and please stand up. Joe Dunn these vice president of real estate development Omari beta development project manager and MJ sassy and intern in the Housing Development Department at Becker Dyke. The ordinance under consideration is a means to close out a 2005 new homes for Chicago Redevelopment agreement. Under the proposal the city would get back to 5 Lots you see listed here. valued at almost 972,000 Bricker deck would be allowed to retain a partially constructed building at 3047 West wabansia. Picker die currently owns 140 rental buildings which housed over 3,000 residents and nearly 1200 affordable units. Here is a map which shows the parcels under discussion. The green dots represent Lots which the city would be taking back. The Red Dot is the location of the partially constructed building. 3 of the vacant lots are in Humble Park 2 are in West Town. The Authority for the original RDA was granted by Council in 2005. An RDA amendment was approved in 2010. And between those dates of course was the real estate crash and the Great Recession. The 2005 Authority was for bigger Dyke to build up to 32 units. The 2010 Authority reduced to maximum number of units to 13. Due to economic editions only 6 homes were built and sold. Construction in a 3-unit building on wabansia intended to be sold as Condominiums began in 2008 bigger deck received Illinois donation tax credits for 7 Lots in the original RDA a regulatory agreement still Encompass 4 of the lats to be reacquired by the city. IA has agreed in principle to release their regulatory agreements if and after the city council approves the ordinance under consideration today. The city will not take back the lats until the Ida board releases that agreement. Here are the 5 vacant lots to city will be taking back into its inventory. The 2 L on the left are quarter lats. This slide and the next show the 3-unit building on what bands? Yeah that bigger Dyke will retain incomplete as a rental building. Without City requirements related to construction or rent affordability. The photos are now 3 years old. The building is in Fair shape, but as you see there are some issues. As shown on an earlier slide There is almost 409,000 in the construction escrow to help complete construction on the building. What's for cost approximately 1.3 million? Again, when the work is completed Burger deck will own the structure at least the units. So yeah, we're we're basically eliminating the the agreements we'll we'll take the lats back they get the building and we're done. so they'll get the we'll take the empty lots. They keep the building and the lot that was part of yes. Okay. Um, Why does that Building look like it's in such terrible shape and why haven't they completed? Is anyone here from bickerdike? Yes. Yeah, do we have someone from bigger Dyke they can use the Hey Joe and for the record if you can introduce yourself and direct the comments to the chair Uh chairman members of the committee for the record Joe Dunn vice president of real estate development at bigger deck re development Corp. Uh, the building has sat vacant, uh, per the terms of the regulatory agreement. The building was to be built as uh, uh, uh for sale Condominiums and after the market crash the economics of being able to build those and sell them at uh, the required prices, uh, are are upside down. Uh, so the building has sat vacant. We've been working, uh with the city and Ida, uh for a number of years to try and bring a resolution to this Redevelopment agreement and with uh, working with Brian over the past year and and Omari became was hard work, but I think we've been able to uh, we've been able to advance it to get to this point, but the building has sat vacant we've had it insured as a vacant property. We'd secured we're over there relatively regularly to make sure uh, no 1's in or out of the building. Um, but we haven't been able to proceed with any work, uh as it's been encumbered by the the regulatory agreement. Thank you Taylor. What is what is the condition of the current builders that you all did build and is there a cost in them returning a lot is the city paying them anything or they're just they're reconvening them to us. I didn't hear the first part of your question. I'm sorry. What is the condition of the other properties are they sold are are the 6 homes were sold 6 homes. Yeah. They are rent they are they were buying are they rented? What is the at the time they were sold, but it happened to them since I I don't know. They they were sold to home buyers who were qualified at 60% of Ami at the time. Um, and they're um, they're they're privately owned properties at this point. So my question is through the chair. Can we get other properties that bicker like owns because my concern is this group coming back to say we want other land or more land when they're relinquishing us land back already and that seems to be a problem when 1 thing doesn't work and 1 community and this is no disrespect to them. This is a developer's period it seems like when it doesn't work 1 place then they go to another community and do it somewhere else and don't do it quite well and I would want to see um, the prices of those homes because even if they come back to us and say hey, we would like more land to build more. We build in 40050000 homes that nobody could afford a certain communities. And so I I I would want to do the chair. Can you give me that information? Yeah, I would like to see what that portfolio looks like and see what is there another community that you all developing in? Uh, we're working right now on uh strictly on the north side of the city of Chicago. So, uh, uh, mainly Humble Park West Town Logan Square, uh and working on a deal in Edgewater right now as well. Uh, I also want the building that's currently has been sitting vacant to be finished and bigger that has committed to finishing that building so that we can get affordable rentals to families in the community like in my ward and many other Awards, right? We have a a gap of affordable rental units. Uh, but we also need to be building affordable, uh home ownership opportunities. These Lots will allow us that opportunity in my Awards. We have uh 6 City Lots. These will be in addition to those. We're looking at building an RDA development, um with inherent or possibly another developer to build the type of affordable single family homes our community deserves. And so we're excited to have these Lots uh to added to the stock of lots that we have in the 26 Ward so that we can get homes in the hands of residents as soon as we can. Uh, so I asked for the favorable support of all my colleagues in the chamber so we can get it across the Finish Line have these Lots back in the ownership of the city so we can do what's needed. I'm here today to indicate his support for this ordinance designating 2033 North Kingsbury and 2032 North Clybourn part of a low affordability lower low low affordable Community. The state tax credits will assist in bringing much-needed below market rate rental units to the near North Side Community as part of this larger project on currently vacant land and in a vacant building between the 2 projects. There will be a total of 96 affordable units, uh on Alderman Hopkins behalf. I ask for your favorable consideration. You also have a letter of support on file and the development team is here to answer any questions you may have Thank you. Uh, are there any questions for our city? Council Alan Taylor? Uh, we just got the zoning approved, uh by the city council this uh, very uh, very recently so we're in early days. And so y'all resand it without doing any environmental on it. What if it's not environmental clear what will happen we we would do remediation. And who was that on the developer or the city? Uh, both of these are private Developers. So, I'm sorry. Good afternoon, Mr. Chairman and members of the committee. Um for the record, my name is Nicholas settle. I'm from the first word office and I'm here on behalf of aldermen laspata, um to recommend approval of this item this ordinance is to designate the Redevelopment lot at 2418 to 2430 North Milwaukee, which also has the approximate Fullerton address of 2930 to 2950 West Fullerton as a low affordable Community. Um, this uh site is currently improved with an approximately 5 story. Existing storage you unit. And there is a zoning map Amendment pending for the July city council meeting that would help with the Adaptive reuse of this building and construction of an adjacent mixed-use building that will ultimately bring 62 units of housing to the Logan Square community area including at least 12 in limit affordable units, uh with the passage of this ordinance. There will be the same state rebate program that was previously mentioned available to the to the developer if they so choose to take it. So this is this is an older manic action on behalf of aldermen laspada. This is generally a part of aldermen LaSpada's initiative to encourage developers to build more affordable housing in the war. And so we understand that by creating more financial incentive to do so, we are hopeful to get more affordable housing units in the development. So I am more than happy to answer any questions on this and uh alderman laspada, Recommends, uh does uh, uh ask for a favorable recommendation on this item. Thank you, Nick. Uh, there's a the location of the property. In question, that's correct. Yeah, so the parcel in question here. There's uh, there's a 5-story roughly 5 story, uh storage building. It's kind of an angled lot and then you'll see there's an adjacent 2 or 3, uh Parcels that are um going to include a new building. So this is this is actually quite an excellent project because we're saving we're saving an existing building. This is a really important. Um, a really important goal for our community is the Adaptive reuse of existing buildings. So we're going to adaptively reuse this building and then add um, a suitable Edition, um to the west and so that will that will ultimately comprise 62 62 housing units for the housing component of the project 12 of which will be income limited affordable. And um this effort by Alderman laspada is an effort to encourage. Um more affordable housing development on the site. Are there any questions like almond? Uh Taylor? Affordability around a lot, but don't give us numbers. And so while y'all asking us for to give up land to add tax dollars a month. We need to know every presentation that you all have from this 1 on you all should be telling us what affordable is because it was affordable on 1 side of the city. It's not affordable understood and the city needs to create when we ultimately Ely give them land money or anything there needs to be a list created of these houses because it seems like there are no new neighbors there. It's the same people who already live in those communities and people want access to live in different wherever they want to live. It's always available in our communities wise those lists not available in theirs. Older woman tailor, I appreciate your question. So in this case affordability is through the affordable requirements ordinance. I will say through the zoning process. Um, Alderman laspada has encouraged the developer to seek additional subsidies as well that would allow for deeper affordability. Um, we can't require that through a rezoning process. But um, so the affordability at the moment would be through the affordability requirements ordinance, so that would it shouldn't be a requirement. It should be something they have to do they should be written in a contract. That's the problem. That is the problem right there because you're not going to tell me you saying that you said 60 units 60 total units. Yes 60 total units. I guarantee you nobody from our community will be able to even get probably get on the list, but you all will still set up and say hey can we get can we get the clearance? It's an older manic effort to encourage the development of affordable housing on site. Um, this is a plan the site is currently approved with, uh, part of a 2-phase plan development. The first phase of the plan was created long ago, and the second phase was re-zoned in 2019, um prior to To uh, I think in April 2019. Um, so the the portion of the lot that's going to be redeveloped here is a um currently parking behind the building. It's kind of another weird angular lot along Milwaukee Avenue and so on this lot. Um, there is going to be the Improvement of approximately 121 new units of housing, hopefully, um and under the Milwaukee Avenue P. Affordable requirements ordinance in 2019. There's approximately 15% of those units would be affordable. Um, I would say passing this ordinance actually gives the development team the um Financial ability to potentially put more affordable housing units on on the market. So once again, this is typical affordable requirements ordinance affordability units, there is no public subsidy. No City dollars. Um, no other no other um subsidy in this building. But once again if this ordinance is passed we are hopeful to encourage the developer to build more affordable housing on the site. So that's that's the goal here. Once again, it's a it's a Redevelopment site. We're trying to encourage more development. This is something that Alderman laspata and our office is going to be working on in the future. My name is James Michels representing Department of Planning Development with the disposition of side yard properties received from Shylock Builder located in the fifth award. the first 4 lives include the recommended properties within the Fifth Ward, which are 1953 East 72nd Place to Walter green and 6803 South Dorchester to the gates with support from Alderman Desmond. Yansi included are the applicants property location existing conditions and the zoning and agreed upon purchase price which represents 10% of the market value. That concludes my presentation on these any questions Alo. Sure, the shape block Builder platform is the platform we have now for City Lots. So if the applicant, uh lives next door adjacent, we offer them at 10% of the market value. If they don't it would be the market value. The market value is determined by a appraiser that the city had hired. Can you talk about how long what is the requirements because I'mma tell you the problem that I have in the 20th award sure. No problem. So the all these lots to folks they won't get them up. They won't keep maintain them and we still wind up maintaining it. What is the is there something in in shop build is that says the minute it becomes yours you're required to cut clean and make sure it's secured. Uh, yes, they have to fence the property. Once they buy it they have to if they're the adjacent neighbor or adjacent to the property. They'll have to defend some they'll have to secure the property. If it doesn't, uh, if they don't require with maintenance then obviously the streets of Sanitation could go out there and give them finds for after they how was the city enforcing that uh, that would be through the streets and sanitation department, I believe so, that's just so we just leave it to streets and saying to pay attention to whether because I'm going to be honest. I have people who buy Lots they keep me for the 5 years and then they sell them for 75,000. Because we have no there's really no teeth. And so first this was City locks for working family. Is that what was this before? Is that what it was and now it's shot block Builder is that the uh know the working for families is a different program block Builder platform. They can buy through uh, 4 ways. They can buy them through side yards. Like these are side yard Open Spaces. They can buy them for uh, uh commercial they can buy them for 3 flats or 4 Flats. That'll go through the zoning department through the housing and they'll make sure they vetted back correctly. These are just for a side yards for the people who live next door. It starts off. that way so that way somebody says they going to be a garden or it's going to be and then I look up there and build out dating and sold it and build a house on it. And so I want us to go back and look because I we continue to rename stuff and do the same thing over and over again with no results. And so that makes no sense to me. And so I want us to have a real conversation about when we sell property to people who have side Lots. They got 90 days y'all good at taking people Landing take it back from them because a lot of those owners do not do not take care of those lots and I'm getting a phone call about it needs to be cut and clean. And so I'm already using my my my resources and trees and saying to clean up the because I got 3500 and I'm not the older almond almond now has a lot of yeah, absolutely. So and Alderman Scott has the same problem on the west side. And so we need to relook at and have a real conversation about when people purchase because this is not us not saying folks don't have a right and because a lot of them do take care of that land a lot, but they need to be gated up cut and taken care of in the right place. Thank you Mr. Chair. Thank you Alderman Taylor and and point well taken. Uh, we will this is a a revision that chai block Builder has been uh being Revisited and your points are well taken. We don't want to speculation in this um in this effort. So I'll do Mandell. And thank you, Mr. Chairman. This is not a new issue. Uh, that's been something that aldermen have been asking for and and we just had uh in the first agenda item the department actually retaking taking back land from a non for-profit because they're not going to be able to build on it. You need a policy that you can retake the land back from people who purchases it in our communities that don't actually do anything with it. Uh, that won't get it up that won't build on it. Uh, just waiting for the time where the the 7 years or whatever the that they can hold it for and then they're going to flip it, uh to make money which only increases the value of communities that are struggling right now. So, um, I would like to see the department make a policy about when you take back land. Um, you know, it's nice to give it away at these. Uh, I think people should have the right to purchase land at a reduced price if they're from the community, but when they don't do anything with it, we should take it back. It's our land. until they do thank you. Thank you and point will take in we will work with the Department of planning and the committee uh to to come up with a proposal for the committee. I I do maybe I should Step back and kind of explain the uh, uh stipulations of the side yard Chi block sales. So again the uh the way we Set up these uh conveyance these is at the the purchaser. They're eligible. It's not just excuse me Nelson. It's not just side yards. I'm talking about all of our sales. Okay? All right. That's a good point there. I think the um, um. but maybe maybe better for us to because it is a broader picture in terms of all of our department planning land sales, uh, in terms of what conditions we put in place to ensure that the uh properties are improved in the timely manner for side jars. We have a stipulation that side yards have to be improved within essentially 6 months from time to sale. They um our side these are aside your deals have uh stipulation in the D that there is a reinvestment language so we can we can take action to force a property to uh to take it back from us if they don't improve the property over time. Uh, we do give applicants as least a side jar as a leading see if a 120 days before that gives them time to put up a fence before these 3 and sanitation department comes out there and issues sit, uh, citations and fines at least with the side yards. Uh, there's a provision in place that that prevents them from flipping the property in 5 years. Um, we should uh, well we could well and right we should uh, we can elaborate more in terms of our other land sale policies, but I I from what I hear is just that we uh, uh, we should probably put together a more defined kind of a a policy statement in terms of of uh, what I'm hearing from socially from both almond Taylor. assurances in terms of the how do we make sure people improve the properties and then The uh, uh steps are I guess the critical? uh point of which time that we start taking legal action take property back because that is that is a We don't really have a defined point in terms of that like after like after 2 years you're waiting. How long or at what point do we determine that the uh, that we've given an opportunity for a buyer to make improvements, but they have not then at which point then we'll uh take legal action to take back. Um, why don't we go through the chair and start kind of putting uh, um, putting kind of uh some parameters in place. Alder Manhattan, and then in each of those words so that we can develop policies that you know, don't uh, don't continue to perpetuate the speculation. I think that's what really want to get at. We want to recognize all the women. Um myths also for the Quorum. She's on a um, she just log in she also had requested a rule 59. So can I get a motion to allow all the women met? I'm wondering do do do we put a first right of refusal on those property sales? Would it would that be something we could do? So when we talk about the problem of speculation, like is there a way that we could have that type of um agreement when we make these property sales so that someone is improving it and um, maybe some way to hey, you can't just not improve it and then after 5 years flip it, um, if they're going to make that sale without making an improvement that they have to offer to sell it back to the city first, right? Like could that be something that we we we haven't done, uh, first write a few first refusal, but we do with uh, many of our market rate type sale projects if there's a um, if a land sales for a property, they're intending to build a uh, commercial building. Um, what? Steps that we normally take now is that we won't close on a property until a time of Permitting. So that kind of 1 that does is kind of Ensure doesn't give a 100% guarantee but ensures that that at which point they have building permits in hand that they're pretty close to building a property that plus um verification of uh financing for a project is usually the conditions of a sale of a of a market rate of a project. Um, Given that as well too A lot of these market rate type projects, they'll have a stipulation that the site has to be for example, it has to be built for a I was going to make a community center that is a restriction that falls on the title as well. So if a buyer 5 years down the road 10 years down the road doesn't build anything and tries to sell their property. There is a kind of a essentially a title. Um kind of like a whole and whole encumbrance on property which makes it harder for them to sell the property up. Um, we are looking yeah. I wish we had more 100% failed proof methods but uh, um, um, I think the thing kind of what Alderman Taylor is at the uh, uh, unfortunately, the few bad apples are kind of like ruining for everybody. I I do think that majority people are complying. It's just that the ones that we are not are the ones that are hard for us to figure out. Yeah, element Taylor now Implement all type of stuff all the time. I don't know why this is any different because I got a community that agent trying to find 4 blocks from my house. They're selling 2 homes for 964 thousand dollars. You think all the woman tailor could afford that I cannot and so that is what happening and so through the chair. I want to see how many side lots that we are. Actually y'all don't keep up with it. And that's a that's a failure on us because we work in silos and we're not working together. And so what I'm tired of is how can I explain to people that they can come fill out for schiefbahn Builder? They hope and I've seen it I've seen them do it, but they hold that lot for 5 years, which we should move it up to 10 and then they sell it and we make what little or nothing and they didn't sold it for 75,000. I've seen it done with Gardens. I've seen it done with side lots. And so we got to do something different because I got a community that in a minute. I'm not going to be able to afford to live in. And so we got a real problem. And so I want to see us do something and put something on the books this year. I don't want to go into the new Next shop like build or whatever y'all call it and we don't have this taken care of is went on for too long way too long. And so I'm I'm I don't like stopping people business, but I will this is something that's important to our communities because we're being gentrified out and what they'll do is about a side Lot keep it up. Don't take care of it. Don't cut it the city is still paying that bill. And so while I was saying I'm down to 3500 Lots. Honestly, I'm not because they're still not taking care of it. And so I want to sell something Implement something before budget season because maybe it's a budget priority. Maybe it's something we we we just need to take care of because I'm I'm honestly tired of going through the problem of having somebody come to my office tell me they want to sell a lot and then I look at it 6 months really a year 2 year later and they then sold it and then they build the whole house on it where they're making the money and not the city. Thank you. Thank you Lewis and Taylor and we got a commitment by the end of this year to to develop a policy to address this. I'll do Vice chair Mitchell. I I've been testing with this for the last 10 years as well 1 of the things that I came up with or was going to propose. Um, is that at the time where the city conveys the rights to the property per the deed? We should stay on deed like a mortgage like you know, you you you you take out a mortgage. The bank is still on title until you satisfy the mortgage. I think we need to have some some type of language or contract with them that within the next 5 ten years. I think it should be extended too. I agree with that that if they try to do anything to it, we have a we have a lean on the property. They can't do anything without talking to us. So that's 1 of the ideas that I came out with, you know, just driving around Chicago thinking about some things so I think you please bring that to Legal. Yeah, yeah or what uh alter Michels talking about is that um, um other places that will kind of essentially, um, look for housing type project server place a kind of more than a property. So you're putting in a kind of financial kind of interest on a property which forces them to but they try to sell or try to do something they can repay. Um again, um, Definitely we can look into it. We haven't done some of that before but we can yeah, because that was what that also does is if they go try to get a a uh, if they if they go try to get a mortgage on it or some Finance anointing. The bank won't won't move without the other. Entity with the encumbrance on they won't move without that. So I think that's something but but we also need a I think what Alden Taylor's want. We we want to find me we want to Make sure they're actually taking care of a lot. Yeah. Oh, that's that's right. Absolutely. Well they can but I just want to say to Nelson that if you were to implement these kinds of changes you'd sell more land in the war. It's the ultimate would be more supportive because right now I say no if they're coming in, you know flying in from the community outside of the community. They want to land and buy land in in the Third Ward. Um, if they're not attached to that ward in some way somehow I'm not going to I'm not going to do it. But if we had an ability to safeguard our communities better other than just saying no, uh, that would be helpful and you could get rid of more of your inventory. That's okay, but yeah, I Yeah, I appreciate all your input that was. Very good. Now. This is a great discussion. I think that we we have a commitment from the Department of planning and the Department of Housing and the committee on housing to develop a proposal by the end of the year. I think it's reasonable.
