It's a very good bill we need it for safety. Uh, I want to let you guys know what's happening in other cities, especially in New York when these batteries have been blowing up in towns and we hear about that happening all the time. It's because 95% of them are coming from people who are converting their regular bikes into electric bikes and they're using off-brand not certified batteries to do that 90% of the electric bikes that we're getting today and the batteries that we're getting today in the city of Chicago are being bought online that goes true for scooters as well these if you guys really want to do Something to ban these UL uncertified batteries The Dangerous Ones. What we really need to do is have bacp put out a cease and desist to the companies that are sending in uh bikes here that do not have a safe batteries. They're using non UL certified batteries. I encourage you guys to really go after the online retailers, uh, which will help all of us make sure that we're doing good job keeping our constituent. And safe and not having these things blow up. Thank you, uh chair chairwoman Silverstein. Um, we're as you know, we have a a blanket of moratoria zones across the 42nd Ward that regulate liquor sales. Um, this was to get a better handle on the types of operators that were coming downtown and getting these licenses in this particular case. Um, there's a Rita development underway for the former Lowry's, um, which I think everyone is familiar with it's an institution in Chicago, but they've moved on um, and we're doing this to allow for a very unique entertainment experience with fine dining, um, run by a notable, uh local operator. But um, I'd appreciate the the committee's favorable consideration and the neighborhood association of record driven North residents Association also support this Uh this amendment. This is a substitute ordinance to amend titles 2 and 4 of the Municipal Code by adding new section 2- 36520 and new chapter 2-24 regarding lithium ion batteries. Battery safety standards from micro Mobility devices. Uh, this is an ordinance that I introduced to council. Um, can I get a motion to recognize the substitute Alderman Cardona all in favor? Say I? And he opposed in the opinion of the chairs. Um, the eyes have it. Um, I am happy to have introduced this ordinance. Um lith lithium ion batteries were the leading causes of fires in New York City in 2023 with 268 related incidents that resulted in 18 deaths and 11550 injuries. Um, so now Chicago is um, tempting to regulate those this ordinance requires e batteries and electrical systems to meet UL safety standards effectively Banning the manufacturing distribution sales leasing operation of e batteries and systems that fail fail to meet the standards. It bans reconditioned batteries and sets fines for violating the ordinance. Um, we do have a few speakers here today. Um, I want to call on. Rob's loan the senior VP and chief scientist of us Solutions. We also are going to have Patrick Clary the president of Chicago firefighters Union Local 2. And we also have Robert passen and the chief wagon officer of radio flyers and Tim Stevens the director of engineering of radio flyers. I now call Rob Sloan, um to give a few remarks. Thank you. I'm Dr. Robert Sloan. I serve as Chief scientist for UL Solutions. I'd like to begin by thanking chair Silverstein and the um, license and consumer protection committee for this important, uh, safety legislation and for the opportunity to testify today, uh, you all solutions history began in Chicago, uh, William Henry. Ml Junior an electrical engineer from Massachusetts was inspired to fail Underwriters Laboratories after the organizers of the 1893 Chicago World's Fair hired him to evaluate the safety of the wiring for the Palace of electricity today. You also Solutions is located and headquartered just north of the city in Northbrook, but it operates inspecting tests inspection testing certification and advisory services around the world our majority shareholder UL standards and engagement and UL research institutes, share our mission of working for a safer world through standards development and independent research respectively micromobility equipment like Bikes and these scooters are a convenient climate friendly Transportation option. However, a failure to meet product safety standards has sparked a safety crisis as was referenced earlier in New York City has experienced over 621 micromobility fires since 2021 resulting in 29 fatalities. Cities from Toronto to London have also reported significant jumps in micromobility fires over the past several years as lithium-ion powered e-mobility has gained in popularity. Not only is this bill timely. It also has the right elements to squarely address product safety challenges for micro Mobility. First the bill is comprehensive covering the electrical system of the device as well as the battery the dangerous thermal runaway reaction that leads to fires explosions in the release of toxic gases is often the result of damaged faulty or overheated lithium ion battery cells. However, the safe performance of the battery also depends on its compatibility with the electrical system that's used in and the design and construction of these components. second the bill references the American national standards that were developed specifically to mitigate the fire and electrical safety risks associated with ebikes other micromobility devices and the batteries that power them you all 2849 for ebikes you'll 2272 for E Scooters and yield 2271 for batteries were developed through a balanced consensus driven process that convenes experts from across industry and government. We note that other ebikes standards often billed as a equivalent to UL 2849 are more limited in scope than you will 2849 and have less rigorous electrical system requirements including for the battery. Third this bill properly addresses Conformity assessment through certification the process of certification includes testing to evaluate whether the product meets the standards testing requirements as well as a thorough engineering evaluation to assess the products adherence to the design materials and construction requirements of the standard moreover certification includes ongoing surveillance under the OSHA nationally recognized testing laboratory or nerdle program products that are certified by the narrator are required to have ongoing inspections of their manufacturing facilities multiple times a year during those visits products under production are assessed to verify that they continue to comply with the standards certification is an ongoing process that supports continued compliance. Safety standards and product certification are consumer friendly policies not a threat to a robust and Innovative market for micro Mobility products prior to New York City implementing these requirements. The number of certified micro Mobility companies on the market was relatively low. Today you all solutions is alone has certified ebikes for approximately 50 ebike companies covering hundreds of models when considering the number of ebike certified by other third-party certifiers. The total number of certified ebikes available is much higher. You also Solutions strongly supports this ordinance and applauds the efforts of aldermen Silverstein to protect the citizens of Chicago from the fire and explosion risks associated with micro Mobility devices. I'm going to ask um Patrick Clary to come up and say a few words and then um, lastly we'll have some people from Radio Flyer and then we'll open it up to questions too. All of you. Good morning. Good morning. Can you hear me? Yes. Hi. I'm Patrick Clarin the president of Chicago firefighters Union. Thank you for having us here. I appreciate it. Um, I concur with everything. He just said, uh, we we respond the fire is night and day and we haven't had the onslaught of fires at New York has had just because these batteries have not made it this way yet this far west but they're coming and uh, it's not just the batteries. It's also the battery chargers. They need need to be UL. Uh, Supported you know, they have to be you all. Um, if you put a battery in a non UL a UL battery in a non UL charger, it's going to overcharge it. So it's it's a danger and when I respond to high-rise fires or just on regular high-rise runs, I see them charging these bicycles in their hallways or if you go to a large apartment buildings, they're where do they keep their bikes underneath the back porches? And those are very combustible things. I mean if a back porch catches fire that's tragic. So we need to stop. The onslaught of these um, batteries and chargers that are coming in that are secondhand not market rate, uh chargers and batteries. Um, I know that the commissioner from New York is currently seeking a federal ban if they're not uh, UL rated. So anything you guys can do this is a public safety issue. It's not just because I'm concerned about the firefighters running into the burning buildings. It's it's a public safety issue because the building's going to catch fire. And it's going to be tragic just like what happened in New York. It's it's outrageous 600 fires 21 621 fires. That's that's a lot. So anything you guys can do. I deeply appreciate so thank you. And then if we could have Robert passen or Tim Stevens both of you, could you maybe just scoot over and bring up a chair so they can and if you could just identify yourself. A Radio Flyer is going to share more on our compliance testing and certifications. Thanks Robert. So I'm Tim Stevens. Like Robert said I'm our director of engineering and quality. So radio fire performs compliance test testing with the help of several Global recognized third-party Labs such as Underwriters Laboratories or UL Solutions. Um and SGS. So both of these labs are certified, uh to test UL ISO in D in uh standards, which is a German cargo bike standard. Not only do Radio Flyer electric bikes meet the UL 2849 electrical system standard, but all electrical and mechanical systems undergo extensive fatigue abuse performance and environmental testing. So these internal requirements from radio fire ensure that our frames forks and electrical systems meet and exceed our extended warranties. Our flight speed lithium ion batteries are tested to meet you all 2271, um, the standard for Lithium-ion batteries and light electric vehicles, um during product development. Our team works battery safety experts to develop, um, our lithium ion battery packs and make sure that our battery management systems are robust and the battery protections have multiple layers of protection just as important is the safety of our batteries. As I said before is the charging as well. So all of our chargers are certified to UL 1310, which is a common standard for lithium ion Chargers, um, in addition to electrical testing. We also focus on a wide variety of mechanical tests. So fatigue tests for our frame forks and handlebars. All of our bikes are designed to meet ISO 4210. Um, it's an international bicycle safety standard that covers the high range of tests with high impact and fatigue and then for our cargo bikes specifically, we follow uh, German standards, which is din 7901, which is even an elevated, uh requirements compared to ISO 4210. Thank you. Um, I just uh, I think my question is for um, Pat Clary from fire but anybody can chime in? Um when you do have a fire from an ebike, um, you can't just get that out with a hose and water. You need a lot of water to put it out. It's not it's not like a regular flame where you just spray water on the flame and the flame goes out it continues to burn it puts out gases and and it provides its own heat its thermal runaway and it just continues to burn. So what we sometimes try to do is if you have it fill a bathtub up with water and throw it inside the bathtub to keep it in the water, but you can't always do that. The best thing to do is to prevent prevent it from happening at all, right? So yeah, it's extremely helpful. These are very dangerous fires. Yes, they're hard to put out is Just it's not a regular fire. It's it's different it it propels itself and it continues and then even after they're put out. They can start to regenerate heat again and start up again, especially with cars. I know we're talking about cars now, but the cars we put the cars out. We take them to the junkyard. They start up on fire again. So the these batteries are very dangerous. They got to be UL rated. Is there anyone else that? I totally agree. I guess identify yourself. Again Rob Sloan Chief science field Solutions fully agree with with uh, what patches said the 1 added item is um in responding to these fires FDNY often times is getting there in 3 minutes and it's not making a difference in the health and safety outcomes for the public. These are not traditional fires. These are more explosive than that. So they they are more like um explosions. So so reducing the frequency of the fires is tremendously important. It's also important to um to provide infrastructure for charging, uh, and storage of the of the batteries as well. So they're not at all like traditional fires. Does anyone have any questions? Um, Do these uh, you mentioned somebody mentioned early on I think Mr. Sloan these were or maybe Paul did Paul Rosenfeld that these were online purchases. People are buying them, you know, maybe cheaper ones online. Uh, do we see local retailers selling these as well? or maybe selling ebikes or just the batteries the batteries. Um, I don't know about the Chicago area. We do see that in New York, uh in particular, I believe they're available throughout the market. So it's not online only. Okay. Yeah. I know. There's a couple of shops that recondition batteries. I'm not sure if there's there's nothing there's nothing currently to prevent any retailer from selling batteries that are not certified. yeah, and uh second, um You know us I thought US Customs or dot regulated, uh, all sorts of electronics and items do they set a standard as well for what they allow in or are they just basically saying um You know if they if they've been minimally tested or what do what do they do? Because I I thought that they highly regulate uh, these types of products coming from overseas. I know. Yeah. That's Tim Stevens from Radio Flyer. So a few years ago, There wasn't a UL 2849 standard for ebikes. So the government or the cpsc was referencing, uh, 16 CFR 1512. It's the old bicycle standard. So it doesn't have any electronic testing. So, uh years ago, that was the reference or there was European standards to reference but purely all voluntary and not regulated by the US and so when they see uh, I I don't know if you kind of pushed this to the National level, but if you're doing it in if they've done it in New York, we're going to do it here, which I think is a great idea. Is there an effort to uh, push it to the National level? So we're not seeing people walk over to Indiana or Wisconsin buy it and bring it over here commissioner Kavanagh from new New York fire department is currently doing it. Okay in the process of it. Cross the border into Chicago which I would say, which Flyer is real close to Oak Park and Elmwood Park, you know, know, my word is surrounded by 4 Suburban to the suburbs and bringing these into the city so I know we can afford so we have a bike shop in Chicago, but I'm worried about this getting out of control and just people buying them from. Online or in the suburbs. So is it something we maybe think we need to work with what our state reps about. Do you have any suggestions maybe so I'm just going to take a quick stab at it. But of course, um, anyone else can chime in because we've had these discussions and I know in New York, um, their what they would call the ACP here is actually they have worked with Amazon and Amazon, um is working is not allowing. Um those products to go into New York. So my next step what obviously be to to reach out to be here to do the Same thing and yes, of course, we're starting here in Chicago, but would love to get this Statewide. This is you know, these ebikes are very very dangerous and the more support we can get From our state and our surrounding suburbs, um the better as far as I'm concerned we have we have to work together obviously because it's like I see for me for you for Matt. You know, we're all we're all surrounded by the suburbs where they could just go across the street and get these unsafe products. But but thank you very much if there's any do you want to add to what I said or did I cover that pretty well, I think you covered it very well, but the only other uh layer I would add is I know from personal experience that the FDNY is also very active and enforcement. Um, they have people who are looking especially for the shops that are are selling, um products that are not certified along the way so they do have feet on the ground to take a look at at um, what's happening, uh within the communities so that has been a pretty important part of enforcement within New York can can somebody's people be ignorant to the fact of this or could they just don't care do you they they they can be at times. So what I'll say is if if the uh ordinance is passed its you know, New York pass the law. We then have a way to uh, At least within our organization also SGS and the others to police our Mark. So when we see fraudulent products, whether it's an online portal or a retail shop or whatever, we have a way to then address that and and surface that and take care of it without the regulation in place the ordinance in place. There's no real um basis on which to to help out with the enforcement piece of it. All right. Thank you madam chair thank all of you for speaking in this uh, very important and and dangerous item. And so whatever we could do as a council and and as individuals to help support that obviously we will see if D is a great partner when it comes to that. So wanted to put that out there, correct. Yeah, the public Ed could probably put out articles to educate the public and then also the fire prevention burial could do inspections to look for these if they're not UL approved, right? So because I again I just think we're going to see back, you know, there there's there's more and more batteries in our in every you come in this way, and I'd like to attack it before it gets here because New York had a had a bad day. Um, as you can make it to the meeting Alderman Martin introduced this ordinance to lift the tavern moratorium on Montrose Avenue from Western to the river to allow dog friendly bar. The b r to open at 2457 West Montrose. Um, this comes after the bar received zba approval for a special use permit for their Tavern license, um, in addition to participating in a community meeting the bar worked with our office and neighbors to address concerns related to waste management noise abatement and a proposed outdoor patio and in response to noise concerns, the applicants have agreed to forego seeking a patio license. So they're just seeking The Tavern license. Um, this proposal is also supported by the north central neighbors Association as well as the Lincoln Square Ravenswood Chamber of Commerce. Thank you. Good morning, uh chairwoman Silverstein and members of the committee on licensing and consumer protection, uh for the record Charles Sturridge, um 35th Ward. Um, I am here this morning to testify in support of an ordinance. We introduced to Lyft the packaged Goods moratorium on a portion of West balm on Avenue. Uh, the purpose of this ordinance is to allow the operator of a um new uh convenience store that is working to open, um in that area to obtain a packaged Goods license, uh, this area was um previously in the 333rd Ward and the operator had initially, um, engaged the 33rd Ward office around lifting that moratorium. Um, they've advised us that they were um, Satisfied um, they were pleased with um, the operator, um how they went through their Community process. Um, and so we want to um, respect and honor, um that process and those um, uh conversations that occurred previously with the 33rd Ward and so are hoping to uh close the loop on the legislative side today to um, allow the operator to um, obtain their package because license, um, happy to answer any questions and um, if not, I humbly ask your favorable consideration of this ordinance.
