We commend Mayor Johnson commissioner Boatright commissioner. Boatright commissioner Catherine a and the administration for putting forth a thoughtful proposal that will complement and add to exist. complement and add to existing efforts to Spur inclusive and Equitable economic. and Equitable economic growth and job creation across Chicago without increasing. Chicago without increasing taxes The Proposal before the committee today. committee today relies on as a Civic Federation correctly calls it. calls it read re resetting Chicago's over usage of tips. while recognizing the value that tips can continue to As an economic development tool when? targeted ways in recent years. Tibbs have failed to generate the the type of catalytic development and in an areas across the city that need it most while also providing administrations and Council. administrations and councils a fallback Revenue source to close budget gaps. close budget gaps relying on the expiring Tiff Revenue to support development. support Development Across. The city is smart and timely particularly as 47 Tif districts are due to sunset in the next 4 years. next 4 years and the city and its sister agencies like CTA. and CPS face significant Federal funding. and CPS pay significant Federal funding Clips, although the proposal hinges on larger questions around tiffs. We cannot lose sight of the fact that these bond funds will allow the city to invest in critical needs such as funds for small business. business support jobs and Workforce training programs and affordable housing and homelessness support at a time when we are in intense National and Global competition for jobs and investment while supporting the fundamental concepts. and proposals. We would like to highlight some concerns as mentioned. mentioned and identified by credit rating rating agencies our Our City's finances are about to enter enter a precarious moment. As federal funds dry up amidst other budgetary pressures. cost drivers continuing to rise we agree with cost drivers continuing to rise. We agree with the Civic Federation that this proposal does not account for the upcoming. upcoming Chicago property tax reassessment which could materially impact the proposal given the increasingly uncertain prospects. uncertain prospects for Chicago's commercial real estate sector and the challenges. sector and the challenges continuing to arrive from the mismanagement of the Cook County assess. mismanagement of the Cook County assessor's office lastly while we are encouraged that the oversight and transparency guard rails have been put in place via the sub. language the recent track records for City agencies. administering and deploying these types of large programs does give us pause. We strongly encourage the administration to work collaboratively with other levels of government and the business Community to identify leverage these bond funds with private investment and existing federal and state capital dollars. existing federal and state capital dollars, uh, along with other ongoing economic and Workforce Development initi. initiatives to close. I reiterate that the good and this proposal outweighs the potential concerns and the Chamber remains optimistic that this 1.25 billion dollar funding Mech. mechanism will support efforts to Spur inclusive. MPC is a nonprofit policy and planning. nonprofit policy planning organization aimed at building equity in the built environment for the Chicago land area. I'm here on behalf of. I'm here on behalf of MPC to express support for the housing and economic. housing and economic development bond in proposal. families across the city are struggling with housing affordability. affordability and many communities need Investments to build. vibrant commercial corridors with diverse businesses Vibrant commercial corridors with diverse businesses. We believe this proposal Can Be an Effective solution to address both challenges by Prov. address both challenges by providing an immediate Revenue stream at that can be used to support. stream at that can be used to support development where it's most needed and critically we supported because of the new borrowing will be paid over time. new borrowing will be paid over time by revenues from existing Tif districts. MPC Recent research on financial development incentives has shown that incentives for community and economic. shown that incentives for community and economic development largely have not in the past. development largely have not in the past gone to areas that are most star for development and resources. This is largely because the biggest development. largely because the biggest development incentives program. Tiff was not set up. Tiff was not set up to generate dollars in develop in neighborhoods. neighborhoods with greatest investment. that the That the geograph the geography limitations were fun. can be spent insurers that the Investments. can be spent insurers that the Investments that are used this proportionally in areas where private invest. this proportionally in areas where private Investments are already occurring also contribute. already occurring also contribute to Resource gaps across neighborhoods and important lesson that we've learned that is Tiff and not baked into a program from the onset. There is little chance that the outcomes will then be equitable. is little chance that the outcomes will then be Equitable what the proposed housing and economic development. what the proposed housing and economic development program. We have a new opportunity to Center. We have a new opportunity to Center develop Equitable development from the very beginning without geograph. limitations. This proposal will not be a Panacea for the city's Housing and Development needs. city's Housing and Development needs but if executed well it can make tangible. it can make tangible impacts to long-distance areas. we We have confidence in this proposal because new debt will be paid over. be paid over a relatively short time period while shifting away from the over. away from the overall Reliance to test to incentivize development we development. We are also encouraged by the commitment to transparency and account. transparency and accountability and regularly publishing data on all. data on all Bond funded projects for this proposal to have Maximum Impact goals and selection. Maximum Impact goals and selection criteria must be clear. Chicago can be a How It Centers equity and neighborhood need for the deployment and development incentives that we recommend that the strong consideration be given to funding projects that include housing affordability to special populations such as those re-entering from prison, um and whose income are much less than the M area medium and proximity to transit to Priority project selection criteria, we are also encouraged that the continued use and refinement data driven strategies and criteria for ensuring that Bond funded projects work to truly close gaps between high and low resource communities and work with existing Community plans and stakeholders to determine where funding and projects are needed we see this proposal as a positive step to making development incentives programs more Equitable, thank you Thank you. Builders about our support of the housing and economic development bonds. My name is Kamina Brooks and I serve as director of development. director of development for the Community Builders a nonprofit. nonprofit mission-driven developer. tcb's mission is to Tcb's mission is to build and sustain strong communities for all people can thrive. for all people can thrive. For nearly 25 years TC. For nearly 25 years TCB has helped build strong mixed income mixed-use neighbor. income mixed-use neighborhoods throughout Chicago, including Oakwood. including Oakwood Shores a public housing Redevelopment in Bronzeville. Bronzeville, 4715 Western and affordable Ito d Bronzeville, 4715 Western and affordable Ito D in Lincoln Square and assemble Chicago a future affordable mixed-use development in the loop. Oakwood Shores is a thriving mixed income Community. However over 1,000 homes remain to be built the However over 1,000 homes remain to be built. The supporting Tif districts funding is insufficient for this. Tif districts funding is insufficient for this scale of remaining Community Development. However, the housing and economic development bonds could complement the Tif districts deficient resources to advance development phases in the community including housing. in the community, including housing and neighborhood retail. affordable housing in Lincoln Square at 471.15 is made possible because of a TIF district expiring this year. Going forward the proposed bonds rather than Tiff. going forward the proposed bonds rather than Tiff will be necessary will be the necessary tool to support this type of opportunity area ET. another example assemble, Chicago Another example assemble Chicago can deliver over 100 affordable apartments in the loop for our lower and moderate income downtown. moderate income downtown Workforce. in partnership with the YMCA In partnership with the YMCA assemble Chicago can also transform this long. transform this long troubled section of State Street to benefit all of Chicago. However, this site is not eligible. to receive Tif funding. These 3 examp. These 3 examples demonstrate how a housing and economic devel. development Bond could help increase the delivery of affordable. affordable housing to equitably build and sustain strong mixed. mixed income neighborhoods and corridors. I previously worked in. I previously worked in Charlotte North Carolina where housing bonds have long been a Valu. housing bonds have long been a valuable tool in Charlotte. I experienced firsthand. I experienced firsthand how housing bonds help create Ito. anchor mixed income neighborhood Redevelopment and stimulate investment in under resourced communities. the city of Chicago Chicago Housing and economic development Bond presents an equally impactful tool to deliver Ito create more inclusive. create more inclusive opportunity areas and stimulate. investment in South and West Side neighborhoods. And I commend Mayor Johnson and his team for putting forth. this extremely valuable tool in Chicago. this administration's cut the tape initiative and housing and economic development bonds can truly contribute. to our city remaining and sustaining and affordable. world-class City. for these reasons For these reasons I expressed support for the housing and economic development. economic development bond proposal and respect respectfully request. request your support as well. Morning finance committee. morning, finance committee, um honorable chairman Dao um for decades the balance between uh production and Um for decades the balance between uh production and um, and delivery has has alluded. and delivery has has alluded to Chicago's equilibrium. We're behind in thousands. We're behind in thousands of units and um, and I know U, behind in thousands of units and um, and I know uh, some of my colleagues in Milwaukee, they delivered 700 a units last year and it's like a 9th of the size of Chicago so we should be producing about 6,3 So we should be producing about 6,300 affordable units a year. Um, so we're behind and that's something that have to be done. So I'm here. be done. So I'm here to express my um faith and commitment. commitment, uh behind this uh initiative. commitment, uh behind this uh initiative because it's the right thing to do for Chicago. um Um the housing and economic development Bond presents this promising opportunity. promising opportunity to address the long-standing challenges this initiative. challenges this initiative had a potential um to for a new funding mechanism to streamline the process and consequently, uh enhance. consequently, uh enhance production and hopefully reduce, uh time and cost. I'm also working on a couple of projects that have been 7 plus years and I have about 2 more affordable projects that uh, we assume that they uh financing because um the tip uh financing because um, the tip is insufficient. um, so you know and Um, so you know, and we're just 1 small company. I'm sure that a lot of colleagues in here. that a lot of colleagues in here also have you know hundreds probably? thous Thousands of units in the pipeline that need this financing tool. um and so, you know as a lifelong Chicago and a community developer, um, I've seen decades upon decades go past. Um, and some neighborhoods that have no, you know, no activ. in some cases. They have the client because they don't have the tax. the tax bases to support. Um, you know, the incremental tax increase that Tiff, you know, increase that Tiff, you know uses to to to provide finance and put these projects. Um, and so this hopefully will alleviate um, the Reliance on Tiff and we can steer resources to uh areas that need it the most um and um, and you know growing up in Chicago I've seen you know, a lot of buildings get demolished and we now have this huge issue. issue with uh what they can land and that's 1 of our most valuable resources is activating this vac. valuable resources is activating this vacant land. It can do so much for our our neighborhood to so much for our our neighborhood to can create economics or economic engines for these neighborhoods. It creates density, which is 1 of the most important things to the city to create economic activity. Uh, it it supports the schools. It'll help people accountable. Um, these lots have to get activated. Um 1 to get activated, um, 1 way or another and this can be 1 of the tools that we can use to. the tools that we can use to activate these these uh vacant processes. and again, um, you know And again, um, you know by activating these Parcels it it will make you know every community. will make you know, every Community a neighborhood of choice. You know, I live on the west. choice, you know, I live on the west side, but I frequent all type of neighborhoods and it's and it's depressing to see 1 side of a city. Um, see 1 side of a city, um, unproductive while the other side is thriving and it's very it's hurtful. is thriving and it's very it's hurtful as someone from being from Chicago and so, you know, being from Chicago. And so, you know, I support this project not this project I support this initiative, um, wholeheartedly um, because it's just the right. wholeheartedly um, because it's just the right thing to do for Chicago. That is why. That is why we are pleased to be able to support mayor May. Mayor Brandon Johnson's bond proposal. the proposal to allocate tax revenues from expiring The proposal to allocate tax revenues from expiring tax increment financing districts is a reasonable. increment financing districts is a reasonable approach to funding the city's critical housing. funding the city's critical Housing Programs. We recognize in particular. in particular that this program does not rely on addition. property taxes to execute. with With this proposal comes long-term funding source for the cities. city's Department of planning and development and the department of Department of Housing. However that promise Department of Housing. However, that promise re-emphasizes the importance of accountability and transparency in City decision-making. It's our belief for this proposal to be successful. The city will need to build on the foundation of support. of support it has received for this plan. of support. It has received for this plan from all stakeholders to engage all voices. stakeholders to engage all voices and opinions for our part the realtor part. Economic Development Bond. Because from where we sit. Because from where we sit we feel like our city faces an unprecedented crisis. An unprecedented housing. an unprecedented housing crisis where too many families and individuals are spending too much on. individuals are spending too much on housing which leaves too little for food medicine education or savings where we have too many tent cities in our midst. where we have too many tent cities in our midst where we have too many vacant lots and vacant. have too many vacant lots and vacant buildings across our city. and where And where frankly when we have too many communities that need. need basic amenities for families to thrive. need basic amenities for families to thrive like grocery stores and health centers and Recreation. stores and health centers and recreation centers and this housing Bond can create a new funding resource. that we That we can use as a city to help address. That we can use as a city to help address those challenges and to build a better City. and to build a better City for all people here in Chicago. to create a city that is more economically vibrant and competitive. But also to create a city. But also to create a city that is more just sustainable. But also to create a city that is more just sustainable and equitable. so I think this is an unprecedented opportunity for us and even though the challenges that we Face are de. even though the challenges that we Face are daunting. There's nothing. There's nothing that we can't do when we collaborate. together. Good morning. Um, I'm presenting the case of Brian magia versus the city of Chicago. It's presently pending in the Circuit Court of Cook County. The plaintiff Brian. MAh The plaintiff Brian magia is suing the city of Chicago for claims arising out of his. claims arising out of his injuries sustained to his leg as well as a brief detention during a protest that occurred on May 30th of 2020. May 30th of 2020 on the Wabash Bridge Mia alleges that Chicago. Chicago police officers committed battery false. Chicago police officers committed battery false arrests and an alleged violation of the Illinois hate crimes Act. an alleged violation of the Illinois hate crimes act all under Illinois state law. May he has sued under Illinois state law may he has sued the city of Chicago only on ethereum theory of responding yet Superior liability, which means that me liability, which means that magia need only identify that it was an employee of the city of Chicago that performed the alleged misconduct and that he was injured by that alleged misconduct. The civil case was filed in the Circuit Court of Cook County on. on May 7th of 2021 on May 25th. on May 7th of 2021 on May 25th of 2023 magia moved for partial summary, Judd. partial summary judgment against the city of Chicago and on August 17th. August 17th of 2023. Judge Moyer Johnson granted magia. partial motion for summary judgement finding in favor of magia on the issue of whether Chicago police officers committed. committed a battery and on the issue of whether Chicago police officers. police officers falsely arrested magia summary judgement was denied as to whether or not the officer's committed a hate crime. So that issue will be for the jury to decide. the ultem The ultimate issues that the jury will decide a trial is whether a battery. whether a battery committed by the police officer's proximately caused me his in. proximately caused me his injuries to his leg and whether the officers false the officer's false arrest proximately causes emotional injuries the jury injuries, the jury will also determine whether a hate crime occurred the jury will then determine what damages to impose on those issues. impose on those issues should the jury find in favor of Mia on the, Illinois? on the Illinois hate crime Mia will also be entitled to seek attorney. seek attorney's fees in addition to whatever compensatory damages our award. damages are awarded. Mia alleges that during the a protest on May 30th the 2020 near Trump Tower on the Wabash Bridge he was at near Trump Tower on the Wabash Bridge. He was at the front of the crowd where a police line had been established. of the crowd where a police line had been established as soon as he got their magia position was positioned in front of the officers and according to Mia. The police officers were acting aggressively towards the protesters including pushing. pushing the protesters and yelling obscenities at the protesters. protesters at 1 Point magia stated that he wanted to leave the prot. the protest, but he could not because a police officer was Building and buys backpack and because the crowd was too tight magia. tight mayia asked the officers to make room so he could leave but he was prevented from doing so MIA then says that he puts his hands. he puts his hands up with his back to police and officer grabbed onto his back. grabbed onto his backpack while members of the crowd also grabbed onto him. grabbed onto him magia claims that he was struck 1 time in the back of the leg by a police officer with a heavy object which which immediately caused him, um pain and he collapsed medical evidence indicates that Mia sustained a fractured tibial Plateau on the afternoon of May 30th and in an injury to his ACL medical experts say that the injury could have been caused by 4 different scenarios. could have been caused by 4 different scenarios 1 a blow to the knee to a fall 3 a blow to the knee with a fall and 4 hold. holding a baton with 2 hands and pushing it against the knee. While he was on the ground with officers on top of him. mihile alleges that he was yelling that his leg was broken. He was handcuffed and 1 of the officers that was on top of him. him allegedly said that's what you get you effing n-word. the only person that the Chicago Police Department knows was actually involved in the detention was a civilian with the Chicago Police Department who was a deputy director. the time the city threw its person with the most knowledge. who was asked to testify in this case could not identify. the other 3 police officers that also detained magia. the other 3 police officers that also detained magia the deputy director was the only person identified. deputy director was the only person identified by the Chicago Police Department that may he participated in mahia's detention and he does not know who the other offic officers were that were detaining Mia and he does not know. why magia was being was on the bridge. He does not know what Miho is doing or saying while he was on? on the bridge prior to the detention and he does not know why. why Miho was being detained. He does not know what any said to me here before he was detained or while he was on the crown and he further testified that he does not know the justification for mahi's detention the city of the justification for Mias detention the city of Chicago admitted that force was used against Mia. admitted that force was used against Mia by at least 1 Chicago police officer. Chicago police officer when a individual testified that he was subjected to an emergency takedown. However, no 1 from the Chicago Police Department. the Chicago Police Department was able to explain why force was being used against me. was being used against Mia nor does it know the identity of the officers that perform the the officers that performed the emergency takedown and it does not know the reasons for the use of force against Mia. There was also No 1 from the city. There was also No 1 from the city to testify whether Mia was or was not struck with baton. was or was not struck with baton to cause his injuries Mr. Magia did suffer. Magia did suffer a pla tibial Plateau fracture along with the torn ACL medical testimony of a surgeon stated that there's a 100% likelihood some level of arthritis would develop Within develop within the next 25 years and even a leg of a complete knee replacement would be necessary. here, it's already been determined by a judge that the city is responsible for the battery to magia and the false arrest. The jury will only need. arrest. The jury will only need to determine the percentage of fault to attribute to the city and under Illinois Law a party found responsible for any percentage of fault is responsible for all of plaintiffs medical. responsible for all of plaintiffs medical expenses. Therefore if the city is found even 1% the proximate cause of the injury the city must pay all of mahia's medical expenses. We recommend settlement in the amount of 750,000 inclusive. Do we know what kind of a prot? what kind of a protest this was? And I know you said there was a lot of people but is it a couple hundred a couple thousand and was it? thousand and was it um, you know, I don't know anything that would be rare did that to America or Rare that the America or uh, a prayer Rally or something. What kind of a protest was? What kind of a protest was this? That would make the police just come in here and start swinging batons. just come in here and start swinging batons and being aggressive and shoving people around. so this So this was the Mets 30th 2020 protests. It was during the time when a lot of people came down to the city of Chicago. to protest the George Floyd incident that occurred in Minneapolis. Um, I believe there were several. Minneapolis. Um, I believe there were several thousand individuals that were present in this particular location. and throughout different areas of the city. Um, so no, I do not believe it was a prayer protest so not believe it was a prayer protest. So most likely then it was an aggressive rally because I saw those riots, uh, and I I didn't see too many peaceful. I I didn't see too many peaceful ones where people were standing in a corner and praying and say, standing in a corner and praying and say peace in our cities and so on and so forth, right I would guess. there was definitely some aggressive behavior by protesters. Okay, uh during the course of these uh protest protests during. Oh we saw it was it was all Know so uh, and once again, we don't know who the officer was that said. was that said this or if he was man woman black. hispanic. We know nothing other than a police officer made. a racial slur to a Hispanic guy. Correct. That issue would go to the jury. However, there's 2 issues. That would not go to. 2 issues that would not go to the jury the issue of whether or not there was a battery that occurred to. or not there was a battery that occurred to Mr. Mia that's been decided and whether or not he was FAL. been decided and whether or not he was falsely arrested that's already been decided that the city of Chicago would be liable for those 2 counts. Okay. be liable for those 2 counts. Okay, and then if reliable for those 2 already, I mean obviously would we be a reliable reliable for the rest of us I would guess right because I'm a little trouble. because I'm a little trouble and torn by this but if we're liable for those 2 I I I liable for those 2 i i i it'd be hard to vote. No if we're already liable for something, correct, I mean already liable for something correct. I mean, I'm asking for your help. I know you you're going to say you could vote whatever way you want. Well, so I yeah, I'm not going to tell you how to vote but that there's been findings of viability against the city of Chicago. viability against the city of Chicago already on this matter, so it would be up to a Cook County. determine what level of damages to assess and 1% would be and hook for a 100% correct. It's a basically a state. understand it sure. It's a basically a state law theory of liability under agency. So that means that a plaintiff can pursue a claim. pursue a claim against the city of Chicago and argue that 1 of its agents or an employees was responsible for the um injuries, and so it doesn't need injuries. And so it doesn't need to prove a specific individual like I wouldn't need to say, um officer Joe Smith committed this misconduct. They just need to be able to argue and prove that it was any City employee and because we know that the Chicago police officers were in uniform on that day, it's hard to uniform on that day. It's hard to dispute that they were employees of the city of Chicago during the time that arrested Mr. Magia. Okay, and you? Okay, and you the medical schools were how much on this so the medical EXP? the medical expenses up to this point are 73,000, but there's anticipated future Med medical expenses with the um the osteoarthritis as well as a a possible knee replacement in the future, which was seems likely based on um, his surgeons. surgeon's testimony. And what was your uh estimation that jury I'm sorry. What was your estimation or what was the estimation if the trial if it were to go to trial? What was that estim? What was that estimation like so um, the plaintiff's attorney? attorney has indicated that he would ask for many millions of dollars. of dollars, um based on our review of comparable settlements and these types of cases with these types of injuries not specifically injuries, not specifically against the city of Chicago, but just in general, um, there's averaged and range from 1.2 to 944. 944 thousand dollars. 1.2 million to 944 thousand. I hope that this doesn't send a signal to anyone. a joke because I think it does send a signal. as we've seen plenty of our As we've seen plenty of our lawsuits send signals. I remember that day very well. as I'm sure As I'm sure you do and many Chicagoans do. This traumatizing day when all hell broke. This traumatizing day when all hell broke loose in the city of Chicago. when pictures of officers trying to hold the line and even some of our own colleagues trying to throw our officers under the bus just for trying to protect. property protect people if we are going to say that. We're going to start paying out for people who acted. outrageously that day. simply because they can. where Where do we draw the line and say no? Well as I stated in this case. Well, as I stated in this case, there is no 1 from the city of Chicago that can testify that Mr. Magia acted outrageously. In fact There's No 1 that can testify as to why he was being detained at all. So that is why the city has already been found Li. So that is why the city has already been found liable for a battery and for a detention and that is why we are recommending settlement in this case. I'm hopeful in that in the future that there will be Witnesses and people that are able to come forward including Chicago Police. are able to come forward including Chicago police officers that can testify as to what they observe. that can testify as to what they observed because that will help the city of Chicago to defend. help the city of Chicago to defend these matters in the future. And do you think our Law Department? and particular the administ administration's plur And particular the administ administration's plural. Have done a good enough job to try. have done a good enough job to try and engender the kind of trust and willingness to work together to make that a reality. I have Department. I'm not going to comment on any other uh individual. individual or Administration well, I think that. an An unwillingness to come forward is because of what we've seen. In the past and what we still? in the past and what we still continue to see across departments when it comes to how we deal with our offic. officers and the perception that they are automatically guilty whenever there's an issue with them. I have very Brave concerns that this will in fact send a message to individuals Who see this as just another opportunity to? Who see this as just another opportunity to get paid by the city of Chicago? for their outrageous careless and indefensible actions. No outrageous careless and indefensible actions nobody out that day was out there. out of the kindness of their heart Out of the kindness of their heart praying rosaries on the corner. I do actually How many similar cases are we looking at right? how many similar cases are we looking at right now? following this model I I don't know what you mean by following. I I don't know what you mean by following this model, but since the protests from uh, George Floyd since the protests from the George Floyd protests, uh, the city of Chicago had about 50. city of Chicago had about 50 lawsuits filed against it and there's probably 15 or 16. there's probably 15 or 16 of those remaining and when are we going to see? we going to see proposed settlements for those 16 remaining? I don't know that you will I don't I can't predict that. When are we going to hit are we going to have? When are we going to hit are we going to have any hearings or briefings or future discussions? or briefings or future discussions about what remains so that we could see if there's a pattern developing. regards to these settlements. pertaining to Pertaining to the riots and what hap civil unrest I'm not. in a position to say whether or not that would happen. the lawsuit be willing to do that. With a law Department, excuse me be willing to do that. I don't. don't speak on behalf of a law Department. That would be up to. to miss Richardson Lowry chairman. I would love. to miss Richardson Lowry chairman. I would love to be able to have a more comprehensive discussion. to have a more comprehensive discussion on whether or not this is going to become a pattern for the remaining. this is going to become a pattern for the remaining 16 lawsuits that we have pending from the Civil unrest from individuals who? Civil unrest from individuals who may or may not have been. not be Not behaving that day. Thank you. We've already been found liable for battery. We've already been found liable for false arrest. This is related to potentially whether a hate crime was committed against Mr. Mahi. Is that accurate? That's correct Okay, so Mahi. Is that accurate? That's correct. Okay, so I mean going back to my the the comments have been made it feels it's It's really unfortunate that we even have to. It's really unfortunate that we even have to have this conversation. Um but we're we're trying to take hate crimes and incidences seriously in the Chicago and part of that has to do with settlement. to do with settlements like this if if we're really concerned with whether we'll see a pattern of the settlements in the future. It feels like our officers getting clear with themselves. getting clear with themselves and maybe with the city on whether they did. Um, use racial slurs against Chicago on use racial slurs against Chicago Ones on these days because that's what we're talking about. Right and it it's easy thing for some of us to talk about when who like white men such as myself who will never experience hate in this same. same way in how emotionally and deeply hurtful. It is particularly when it's used by an authority figure. Um, And it makes me sad that we're even having. conversation, but that's why. Copa exists, that's why the community Commission on public safety Safety exists. That's why we do. This work. So I'm I'm I'm glad that we're actually having this conversation. this conversation talking about the way hate crimes. this conversation talking about the way hate crimes relate to police misconduct. Thank you chair. Although this settlement is based on the false arrests and the uh battery. That's correct. I appreciate it. Thank you. Okay, um Alderman Reilly Uh, thank you madam. Chairman. uh, thank you madam chairman, um as others have noted I was also was also uh, front and center for the activities that oh Front and center for the activities that occurred on May 30th of that year. 30th of that year and I wanted to refresh my memory. So I went on to Wikipedia. To take a look at what? to take a look at what happened, uh that afternoon and it you know, if you read the report you can check it out yourself. Uh by 3:30 p.m. That day hundreds were marching North with some protesters throwing fireworks and bottles at police officer. officers tagging buildings cars and a bus. officers tagging buildings cars and a bus shelter another group climbed a bot a top. group climbed a bot a top 151 shared in CTA bus. demonstrators were gathering on multiple sides of police cars and attempting to overturn them. By 4 p.m. The crowd. By 4 p-m. The crowd is split into several groups, including 1 heading towards. 1 heading towards Trump Tower which was markedly chaotic. throwing bottles fireworks at police officers other pushing police officers and trying to overturn police vehicles. So clearly this was a pretty chaotic situation. Um, and look I I understand that. Um, the law department has to try and limit our liab. has to try and limit our liability on these things. I appreciate the work that you do. Um, but you have to imagine for some of us here. Um, it's difficult going through this exercise of of contemplating. through this exercise of of contemplating, um a settlement for someone who's particip. for someone who's participating in rallies at that time of day. day in approximate to Trump Tower which became very violent. Towards our our men and women in uniform. Who I thought displayed incredible restraint that day. Who I thought displayed incredible restraint that day given all that was going on in the violence that was being directed towards. directed towards them. 1 other thing that's important to note about the bridge understanding that this individual was on. understanding that this individual was on the bridge. This individual should never been on the bridge. The police were told to hold the line. The police were told to hold the line and protect the bridge which they did. bridge which they did nobly for for several hours before they were. they were overwhelmed. So it does beg the question. activities was this person engaging in? activities was this person engaging in and I'm surprised because I know the proximity of all the pod because I know the proximity of all the Pod cameras that have been have been installed along the bridge in on lobash Avenue. I actually have approved. I actually have approved the menu funding for most of them between the Pod cameras and the body cams. We're not. between the Pod cameras and the body cams. We're not able to establish the the environment. to establish the the environment for the level of chaos that was occurring when this person. that was occurring when this person uh was allegedly hurt. Um, I have to figure from all the different Vantage points. There must be something whether police officers can can testify what they they remember. testify what they they remember seeing or not seeing It was chaos it. It was chaos. It was Absolute Total unmitigated. Cha. It was chaos. It was Absolute Total unmitigated chaos, I can't fault those officers, but we do have technology. Um, so I guess 1 question would be um, what type of footage exists that has been reviewed by I'm sure the plaintiff's attorneys, but also the Law Department. So there is a pod camera footage and there is some. So there is a pod camera footage and there is some body cam but as you know due to the chaotic nature of those. but as you know due to the chaotic nature of those protests many police officers were deployed without body. many police officers were deployed without body Cam and finding body cam of a police officer in that scenario under those Cirque. those circumstances is basically looking for a needle in a hay stack. Um, so we do have we do have podcast camera footage of his um arrested detention. footage of his um arrested detention, but I will tell you this there were many people there. this there were many people there and we have to be able to explain why this particular individual was singled out and dragged from the crowd. dragged from the crowd and then placed into a an amb because he had a severe injury he had a broken leg. And I don't have 1 police officer or 1. and I don't have 1 police officer or 1 individual that can explain that explain why this particular individual was dragged away when there were many other people that were not or how this injury occurred when he says that he was struck with a baton. So those are the challenges that I'm facing and I I've I'm not naive to the fact I've watched hundreds. not naive to the fact I've watched hundreds and hundreds of hours of body cam videos from these incidents. You know, I I understand what? You know, I I understand what they it is disturbing and I will also say that. will also say that it would be very helpful for people. will also say that it would be very helpful for people to come, you know, and I'm not trying to suggest that no 1 was willing to come forward, but we seriously just could not. identify anyone who would be able to provide. identify anyone who would be able to provide a defense to the city of Chicago on this particular case. I appreciate your position and and for answering the question. would be some some podcast camera footage prior to the injury that might. injury that might show. What had occurred here with this particular? What had occurred here with this particular individual? Um, so so I understand where you're coming from and the challenges that you're facing and representing the city. um Um again, um, I I understand what we're being. Um again, um, I I understand what we're being asked to do here today. Um, I I do share concerns expressed earlier that uh, especially with the Democratic Convention coming here this fall the last thing we want to do. Uh is help folks. Uh is help folks monetize bad behavior. And so, um given all the uh organizing. And so, um given all the uh, organizing that's being planned to disrupt the convention. Um, my concern is that approving settlements like this. approving settlements like this could help Fuel That Fire. Um, and if someone who watched our city burned down not once but twice, um, we don't want to see that ever happen again. Um, so thank you madam chair. Thank you. I don't know there is an answer. Um, so a couple questions that I thought of as were discussing here where here. Where was this individual from? was Was he did he live a black away? Did he live? Did he live in a suburb? Is that live in Indiana? Do we know where he's from? He he he was originally from the Dominican Republic, but my understanding he'd been living in the city of Chicago for about 25 years before this incident. Was he in the living the 41st Ward? Was he in the living the 41st Ward that he lived in the the 25th Ward. I mean was he? We don't know where he's from. I'm not sure relev. We don't know where he's from. I'm not sure irrelevant to that Alderman spado. Just curious what? that Alderman spado. Just curious what I'm just curious about the relevance of the relev. about the relevance of the relevance of the ward. Here's an indiv. I'm trying to get. indiv. I'm trying to get an idea how far he went to go to the civil unrest because we're saying it's a protest it wasn't a protest it was wasn't a protest. It was civil. Thank you. I just was trying to get content. Yeah, I mean this guy came trying to get content. Yeah. I mean this guy came from who knows where to wreak havoc. knows where to wreak havoc upon our city, you know, I don't know if he's from the suburb. Okay, he's born Dominican Republic. We know that he's here with a bunch of people. people everybody knew it was going on that day. We know it was mass chaos. was mass chaos protests all over the place that and they weren't protest. weren't protests. They were riots pure mass chaos across the city. We don't know how he ended up in the front or how he got sing. he got singled out. So, um, you know, I'm just wondering where did this guy come from to come to something like this? Why was he singled out? I I believe you did say he wasn't the only 1 though. There was other people that were arrested or or or or or bruised up or something like that there. There were many arrests that day from the Wabash Bridge. but many interests that day. we're catching release all over the city because they basically just caught them. throw them in jail and ran back out there to get on the front lines because because of the mass chaos, um, and I'm and I'm just wait and listen we got we got our own. members preaching violence at the DNC. So I mean, I'm also worried like Alderman Reilly is are we you know, what are we doing here? What are we saying to people? Um, and I don't know if we should just use this as a message to say you can't keep doing this we're going to do business with you. Um, I'm just you know, I'm just I'm just torn on this 1 because there was tens of millions of dollars of damage billions of the country. billions of the country that there was many of people that yes. yes, they were civil protests walking around with signs and so on and so forth, but there was a heck of a lot of you know, know 550. I believe really bad throughout the nation. know 550. I believe really bad throughout the nation, uh bad protests with billions of dollars. bad protests with billions of dollars worth of damage people being killed. Uh, uh, uh, people being killed, uh, uh, uh, uh in in in business areas being ported and whatever so, I don't know what went on to him. I mean, him. I mean fortunately we don't have a an individual that we're blaming somebody on but I'm still troubled by this. and um, you know, um, thank you. thank you Alderman spado. I'm just babbling. Thank you Alderman spado. I'm just babbling. I apologize. Thank you. Yeah, yeah. Thank you. I'm frustrated man fresh. frustrating. I know we all we we've all been there. Um, I really appreciate my colleagues questions because this is A little more nuanced than I think people want to admit right there. right? There are definitely folks who went out for prot. protests. There were folks who were agitated to the point. and there were some folks who just wanted to see some level of chaos and I think for the officers that were out there. out there that's not an easy situation to discern. Um that being said and to the point that was mentioned here. were plenty of folks were able to walk back home. were plenty of folks were able to walk back home, uh safely and then you got folks who had limbs broken. I think there's a difference there. Um, I think we also in thinking about how much activity there was. In thinking about how much activity there was should think about why the protests began in the first? about why the protests began in the first place when we think about the incident how it affected a whole nation understanding the people were so moved that they went downtown to do that is something to be considered as well there. There are plenty of people who just wanted to protest and make their voices heard. Um, I appreciate that the podcast camera. I appreciate that the podcast camera only showed so much. I guess my question. guess my question based on all of these factors is um to the point that Alderman Reilly and other people brought up. We've got the D. We've got the DNC coming, uh, there will be situations as well. It'll be Mass protests and it could similarly be that kind of uh disruptions have Uh disruptions have we learned anything about what to do proactively? Maybe it is proactively maybe it is making sure that the officers have their body cameras if they're going out. Um, what has been learned from this case. learned from this case that can help us improve so that when we talk to D. when we talked to DNC or when the DNC does come we're not in similar situation. so So I I think your question would be better directed to the Chicago Police. Chicago Police Department. But I myself am aware that they're doing a lot. they're doing a lot of training and training scenarios to be able to make sure that um arrests are prop. be able to make sure that um arrests are prop properly Pro processed. Um, so that we have documentation of each and every arrest why individuals are being arrested what? and to make sure that everything is properly documented. and to make sure that everything is properly documented so, you know unavoidably there. So, you know, unavoidably there may be a situation where the city has lawsuits filed against it, but we'll hopefully be in a better position to be able to identify the involved in those arrests and they'll be able to uh, provide testimony in favor of the city of Chicago. provide testimony in favor of the city of Chicago as to why their actions were reasonable. Um, I don't know if the specifics of your question came up, but he might be able to give you Sure. So there's approximately 15 to 16 of those cases. cases that remain I don't know how many specific cases relate to the August unrest and is it also incorporate? relate to the August unrest and is it also incorporate the Columbus Day statue as well?
