Um as we get closer to closing, um I guess a a I guess a follow-up noting that it looks like. the original mortgage the the first permanent mortgage is not to exceed 8% the construction mortgage. not to exceed 8% The construction mortgage is not to exceed 12. So ours is usually deferred until the the end of the 30 year period which if anything that means we're higher risk Capital so our interest should actually be even higher than that. I mean, I understand this is probably a broader. probably a broader policy issue. issue, but as Issue, but as you alluded to in your presentation, this area is absolute Boomtown. So the fact that we're we're somehow doing the Tif loan. doing the Tif loan at such a low rate doesn't seem an hour loans. loan for the Tif we're not getting repayment on the tip. Our loan is on the 4.2 Million Dollar City Loan. We're granting the Tif funds. Now it looks in the ordinance. It says Tiff loan 6 6 mortgage loan. It is it's a tip loan generated by. mortgage loan. It is it's a tip loan generated by the city granting the funds to the nonprofit the non. granting the funds to the nonprofit the nonprofit will then generate a loan to the 4? generate a loan to The for-profit Entity and the re that goes to the for-profit and to the nonprofit nonprofit entity. It's not the city. entity. It's not the city loaning the Tif funds. So who who is the who is the entity loaning? Well, I think it's I think it's great in an area such as this where where has astronomical property values that we are doing it as a loan. I think that's that's um, uh good thing. Uh, the only thing like there's probably in the country, uh, and and pretty much if folks didn't know every development in Cabrini. much if folks didn't know every development in Cabrini and and and and Cabrini Green on CH and and and Cabrini Green on CJ's property. Has a partnership. Has a partnership with the residents of Cabrini, so the residents. residents are part owners of this development by 40% Um, and they're involved. and they're involved and engaged in many different ways. Uh, so I Alderman Conway when when they started these things many years ago before we tore down the uh, high-rise buildings or the public housing buildings. This area wasn't Expensive right? Um and uh, because uh, the Redevelopment of public housing that is The Redevelopment of public housing that is area is expensive. So, you know, and and that's expensive so, you know, and and that's not just in my area that's in uh, I don't know. that's in uh, I don't know wager specs area. I don't know who have laytrip same thing with laytrip same thing over by. by uh Alderman. Um, padal over over with Stateway garden and all the developments she have and the same thing with uh, not quite there, but they're getting there over there with uh Alderman bill. Alderman bill on the far south side. Uh, so um, These development. These developments become victims of their own success. right but they're still they're still public. right but they're still they're still public properties. Right and it's still for the lowest income that you can have. have when you talk about cha you talk about some have when you talk about cha, you talk about some people who make zero income, right? who make zero income right or so, it can go all the way to zero income so some and and it goes up to 30% of your income. So so they need the sub. income. So so they need the subsidy our subsidy in order to make these things, right? make these things right? CJ is you know, they started out with a lot of money with the uh trans with a lot of money with the uh, transformation of public housing and as time went on that money has dwindled down a lot. lot and so CJ is trying to do a myriad. lot and so CJ is trying to do a myriad of things to leverage developers to do more. These developers only can do so much. Uh hosting development is not a a a for-profit developer A for-profit developer, uh, they had to leverage and make some money. some money off of this but really they do a lot of uh, uh affordable housing across the city mostly on the North side and the west side. and the west side in the city of Chicago like, um, uh over in Alderman rallies War they just they're the ones who's doing the uh, YMCA building over there. doing the uh, YMCA building over there across the street. So so when When we give Tiff. When we give Tif money, uh to uh, cha development. when we give Tif money, uh to uh, CJ developments like this is not uncommon is what we have. is not uncommon is what we have been doing for the past almost. almost 25 years or more and uh and almost 25 years or more and uh, and and and if we did not do this these developments wouldn't work, uh, you know, it's it's unfortunate that you know, we had to use federal. money. We had to use tax credits from the state tax credits from the city and Tiff in order to make these things work and Leverage The and leverage the private developers money. That's what a the market rate part come in in order in order to make these development developments work, uh in these communities, so I'm just happy to see this. Sorry for the long explanation. That's how old people get we tell a whole bunch of people. You know, how sorry but but want to I mean because he had he good questions, and I just want to just want to get it out there and I'm not saying in my ward in all of our Wars that have cha, so thank you all very much. So I want to thank the department of planning. Thank cha. Thank the developer. Thank the residents for from Cabrini Green, uh for this. Cabrini Green, uh for this development and I supported 100% Thank you. Vice mayor Bernett, and I want to commend you for. for having uh a minority African. for having uh, a minority African-American general contractor on this deal. Um, I saw at the point, um Alderman net when he was losing money. um to make some of this happen and um, especially when we look at Hillyard homes now even look at Hillyard homes now, even who still still stand there and others I uh while there and others I uh, While others are torn down, uh, and when you look at that, when you look at that property, that's because of um, um, what um, hosting development did and what I appreciate and I have no um, no surprise to me. That's a black G. I have no um, no surprise to me. That's a black GC is on there because sometimes you got to twist people arms and fight them to bring um, um minority contractors on uh, posting development. posting development has never been 1 of those people and um, I just want to uh, just say I support this ultimate Bernette said it all but um, these are the type of not only people that we need to be doing development here, but these are the type of project. but these are the type of projects that we need to be doing and the c35. and the c35 hard unicore Arc. The property includes both the former Pioneer Bank building and the adjoining Annex Building. shown here is Shown here is the Pioneer Bank building as it stands today. While the building is overall in relatively stable condition it. condition. It is still in need of extensive repairs. In this photo you can see portions of the building's corn. are missing. The building has additional space on the fourth and fifth floors, which served as the bank. floors, which served as the bank's offices. in the mid 1990s peon In the mid-1990s Pioneer Bank was purchased by Bono popular who? who continue to operate the facility until they move to a new FAQ. new facility in 2008. The building has remained vacant. neglected since that time. In March 2023 the city council approved an all. In March 2023 the city council approved an allocation of 13 million in Tiff assistance. million in Tiff assistance to Tim team pioneros LLC a part. partnership between Park Row Development LLC, and the architectural firm jgma. These funds will be used to to develop the pioneer. building as an office retail and Workforce trained. building as an office retail and Workforce training Hub with 2 community-based organizations. with 2 community-based organizations occupying the ground floor. and the upper And the Upper Floor is occupied. by jgma By jgma who will be relocating their offices and 50 jobs from River. from River North to Humble Park. additionally Additionally the Annex Building next door will be used as a community restaurant or commercial kitchen. However, since the original approval a critical issue was identified that necessitates. identified that necessitates an amendment to the RDA and requires Council approval. specifically the current structure provides funding the team pioneros as a grant which triggers a substantial tax. pioneros as a grant which triggers a substantial tax burden under federal tax law. in order In order to address this the amendment would restructure City fund. City funds as a forgivable loan which provides the developer. developer with more favorable structure to absorb these costs necessary to close on the financing. if approved to funds will be provided at a If approved to funds will be provided at a 1% interest rate and advertise over 10 years. beginning in year 3 of the agreement Prov Beginning in year 3 of the agreement provided the developer is not in the fall. 1,625 thousand of the principal balance of the Tif loan plus any accrued interest will be forgiven. Through the remaining term of the ten. through the remaining term of the tenure agreement 1,625 in principal plus any in crude interest is Forgiven annually until the tip flown is fully. until the tip flown is fully forgiven. This amendment will only change. This amendment will only change the structure of the Tif payment from a grant to a forgivable. payment from a grant to a forgivable loan. No other changes are sought and the existing. are sought and the existing Tiff amount will not increase past the 13th. The change is also beneficial to the city because it provides. provides additional security over the required 10 year compliance period Because any default in the agreement will result in. because any default in the agreement will result in the developer forfeiting the remaining balance of the loan. the estimated to The estimated total cost of construction for this project is approximately 24.1 million with up to 13. of that budget or 54% prop. of that budget or 54% proposed to come from Tiff. The remaining funds are expected to come from developer activity and histor. activity and historic tax credit Equity as well as private. loans. as previously mention As previously mentioned the structure of the Tif dispersement. dispersement will not change if City will reimburse. dispersement will not change. If City will reimburse the developer up to 13 million in Tiff eligible cost. developer up to 13 million in Tiff eligible costs in 2 payments. the first payment The first payment will be provided at the issuance of the certificate of complet. certificate of completion. The second payment will be provided 1. provided 1 year after receipt of this certificate. The city's investment will be protected. The city's investment will be protected by provisions and the RDA that require the developer. the RDA that require the developer to maintain no less than 75% occupancy. 75% occupancy throughout the 10-year compliance period in addition the developer will be required. in addition the developer will be required to satisfy the typical construction compliance require. typical construction compliance requirements for a prevailing wage. overall dpd is Overall dpd is supportive of the proposed amendment and project. the amendment provides the developer with the financial flexibility necessary to close without modifying. flexibility necessary to close without modifying any core components of the existing Redevelopment agreement. The community has long sought to restore the landmark Pioneer Bank building and this project. Pioneer Bank building and this project is very close to ensuring that will happen. The developer has submitted. all outside funding and dpd anticipates. all outside funding and dpd anticipates that if this agreement is approved that the project will begin Construction. Construction in early spring. For all these reasons as well as the significant Community benefits. benefits that the project will deliver dpd is recommending the approval of this amendment. You should when you're going to move into a community and that is to have a series of conversations with Community about what community wants to see in. what community wants to see in a building that essentially has been abandoned for almost 2. has been abandoned for almost 2 decades. Uh, this is the same bank. Uh Uh, this is the same bank, uh where my mother banked. Uh, this is the same bank. this is the same bank where my aunt was a teller. Um, and the same bank the same Banker. I opened an account at the age of 16. the same Banker. I opened an account at the age of 16 at Bank of pulal. And about the last time. And about the last time I ever seen real life, um in what? a historical landmark on North Avenue in Pulaski? I don't know how many of my colleagues have driven. know how many of my colleagues have driven, um through this intersection, but it is an intersection that has some amazing. amazing architectural life that has been abandon. quite some time. Not just Pioneer Bank, but the pal quite some time. Not just Pioneer Bank, but the Pulaski archive arcade building that used to be a bowling alley that also has been abandoned for almost 2 decades. that also has been abandoned for almost 2 decades when you think about the revitalization of our commercial districts, uh 1 we have to have tenants in these buildings. uh, 1 we have to have tenants in these buildings, uh, but 2, it's really important to give them to developers that care. care about keeping the facade and allowing. care about keeping the facade and allowing there to be Nostalgia and historical memory for a community. Nostalgia and historical memory for a community that has been here for so long this particular. been here for so long. This particular development is going to give the building back to community. It's going to allow them to have access. them to have access to this space to be able to share that historical memory. historical memory with generations to come. and btech And btech, uh, and Xavier Hernandez is not here today. Tech is an organization. Um that has Tech is an organization, um that has rooted itself in agriculture and Workforce. agriculture and Workforce Development in providing programming to young people. To be able to have a space on North Avenue Pulaski right now. where we're seeing some of the highest rates of violence in my ward where there could be a safe place. my ward where there could be a safe place for young people to engage in productive. young people to engage in productive academic rigorous programming. is Is the community benefit that the 26 Ward is looking? Is the community benefit that the 26 Ward is looking for? And lastly, you know. And lastly, you know, Juan Moreno who's an award-winning architect with j. architect with jgma is choosing to move his firm. architect with jgma is choosing to move his firm to Humble Park a Latino Le architectural firm that will continue to provide um work provide. Um Workforce opportunities for our communities is choosing to to live in the 26th world, and that's what you want. want in any word that you have is to have uh, successful Latinos be able to come back to their communities to provide those jobs and to provide that silent and training back to the community and back to the community. And so I'm excited about the bank itself. Um, and I'm also excited about the second phase of that and that all of the empty Parcels behind it will build affordable. affordable housing so that displaced residents can return affordable housing. The Department of Law recommends settlement in the amount of 195000. on April 10th of 2018 plaint On April 10th of 2018 plaintiff Lusk was at a stop in his car. car near naraganset in Montrose. plaintiff Plaintiff's car was rear-ended by the Chicago Police Department. Department car driven by Officer Renault. officer Renault provided the explanation that the brakes his car malfunction. The bumpers on both cars shattered as a result of the impact. officer Renault received a rep Officer Renault received a reprimand as a result of this incident. the plaintiff suffered a shoulder tear and subsequently The plaintiff suffered a shoulder tear and subsequently had surgery plaintiff claims. surgery plaintiff claims 166,000 and passed and future medical bills in 15,000. medical bills in 15,000 in loss over time if this matter were to proceed to trial a jury could award damages for pass. past and future pain and suffering past and future loss of normal life and emotional distress in addition to his medical bills and loss over time the medical bills and loss over time. Easter Day injured plaintiff Aisha Hurston when he ran over her foot with his segue while responding to a call for assistance at a rally. The plaintiff was diagnosed with complex. The plaintiff was diagnosed with complex regional pain syndrome as a result of that accident. the Department of Law recommends settlement The Department of Law recommends settlement of this case in the amount of $400,000. on June 15th of 2017 On June 15th of 2017 the plaintiff attended a rally at Rison blue. Radisson Blu Hotel located at Columbus in wacker. Sergeant Easter Day responded to the hotel on his Segway for a call of trust passing. Sergeant Easter Day stated while he was on the hotel's driveway. He was told by a witness that he had run over plaintiff's foot. This witness has not been identified and serge. This witness has not been identified and Sergeant Easter day does not recall hitting the plaintiff. the plaintiff alleges Sergeant Easter day, neg The plaintiff alleges Sergeant Easter day negligently and willfully and wanting operated. willfully and wanting operated the segue. the plaintiff was transported by The plaintiff was transported by ambulance to the emergency room where doctors. room where doctors observe redness and swelling in her foot. a doctor diagnosed plaintiff with compact. a doctor diagnosed plaintiff with complex complex regional pain syndrome and surgically placed a spinal stimulator in plaintiff. The plaintiff has 400,000 dollars in. The plaintiff has 400,000 dollars in current medical bills. an expert oh an expert o Pines that plaintiff will need multiple surgeries over the course of her life totaling approximately. approximately 600,000 dollars in future medical bills. therefore plaintiffs total claim medical Therefore plaintiffs total claim medical bills both past and future are approximately 1 million dollars. if this matter were If this matter were to proceed to trial a jury could award damages. damages for past and future pain and suffering pass. damages for past and future pain and suffering past and future loss of normal life and past and future. future loss of normal life and past and future medical bills the Department of Law recommends set. bills. The Department of Law recommends settlements in the amount of $400,000 for this case. amount of $400,000 for this case the sum of plaintiffs current Medical. current medical bills. Hey you ran over that lady's foot. foot but we don't know where this person is who this person is what? is what type of credibility they have. I mean, I'm still supporting it. supporting it but there's a lot of lot of question marks here is just You're it was a protest, correct? it was a union rally a union rally how many people um, it was a large Gathering it was a large Gathering and part of I believe um Alderman part of your question regarding both the accusations of negligent. regarding both the accusations of negligent and willful and wanton conduct 1 of the relevant facts is just the number there was a large, uh, Rally or gathering the teamsters turned people out. Um, and the officer, uh did turned people out. Um, and the officer did drive the segue into um a large group of into um, a large group of people so certainly um at trial the plaintiff will allege that the decision to drive into um that crowd of uh, rally attendees. um, that crowd of uh, rally attendees, um violated the Chicago Police. Chicago Police Department general orders. Um and V. violations of CPD general orders are used at trial to um, demonstrate willful and wanting uh conduct here. So he basically crowd Byron can sorry. I didn't understand. I didn't hear you. Alderman. Alderman SEL Lopez slide over a little you just slide over a little bit so he can see her eye to eye. I like to see people when I talk to him. I'm just people when I talk to them. I'm just weird that way so I mean he didn't like say Ram. mean he didn't like say ramming speed and saw those people and I'm gonna Ram India and that was it. I mean, right. Yeah, he did sure. There's no allegation of intentional conduct here the um alleg, conduct here. The um, allegations are both that there was negligent conduct. negligent conducts a mistake or willful and wanting negligent conducts a mistake or willful and wanton conduct which is either a conscious disregard. which is either a conscious disregard for the safety of others. Um, or others, um, or utter indifference. All right. Well, I mean I support it, but I'm just going to refer to those as an accident. accident not a not a not he he put the segue on ramming. speed and said, I'm just going to plow a bunch of people down. I noticed that the sergeant was sued in his individual capacity as a citizen. capacity as a citizen and as a Chicago police officer did this occur? this occur while on duty or off duty? This occurred while the uh Sergeant was on duty. This occurred while the uh, Sergeant was on duty. Okay, was he represented? Um, by the city and both his individual capacity and um and as a city employee um, and as a city employee and if this case is settled would this this case be dismissed in full or just to where the department um may be liable. Yes, I understood Alderman. Um, if the council does approve this settlement it will settle the case and its totality. settle the case and its totality, um against the sergeant in both his individual. in both his individual capacity and his capacity as an employee for the city of Chicago the Department of Law. this matter did represent both the city as a mun. this matter did represent both the city as a municipal entity as well as um, entity as well as um the off the sergeant as he was on duty at the time. at the time of the accident. Um, cheer sure. um, and then a question from the chair as to um, the the liability and the representation of um sergeant. liability and the representation of um Sergeant Easter Day in in pursuing to both. Um, the Sergeant's contract, um Union contract as well as Illinois state law, um when an individual commits a to a tour, um at tour, um, an accident a mistake, um in their capacity as employee both under the Sergeants, employee both under the sergeants, um Union contract as well as um under Illinois state law, uh the city well as um under Illinois state law, uh, the city of Chicago and other Municipal entities are required. Chicago and other Municipal entities are required to what's called indemnify that employee and that Sergeant so in this particular case, this particular case, uh, the sergeant responded to a call on duty, um on a CPD segue, um, there are no facts in the record indicating that he was not on duty. So therefore the city of Chicago is required. city of Chicago is required to indemnify, um, the the officer or the sergeant in this case we both officer or the sergeant in this case, we both represented him and our um proposing a settlement to uh resolve his actions, um, and then allegations against the city of Chicago as well. Alderman, uh Lawson we acknowledge you. Alderman, uh Lawson we acknowledge you as being here for this meeting alderman. Ervin followed by Alderman wag his back um Who you you? Who you you stated that there's a million dollars. Medicals here. but the settlement amount But the settlement amount does not equate that. Gives me a little pause as to. Why does 1 do that number 1? Why does 1 do that number 1 and are we really at fault number 2? that's the thinking here. I mean based on your based on what you just told the committee. Um, Why why do you wreck? why why do you recommend based on the fact pattern and there's a lot of? Maybe it is or maybe it isn't. it just seems kind of a it just seems awkward. I just just probably the best way to put it. I'm happy to um debt. I'm happy to um detail and explain a little bit more why I am making the recommendation in this case. So, um as to the medical bills that total of 1 million dollars includes both passed bills what? passed bills what has already been paid, which is $400,000. as well as the $600. as well as the $600,000 in future medical bills, um that are expert in this matter has said that um, expert in this matter has said that um plaintiff will need through uh the rest of her life. through uh, the rest of her life. Um, and that expert is 1 of the individuals that developed the diagnosis for complex. regional pain syndrome. Um, and who regional pain syndrome, um, and who testifies regularly as regional pain syndrome in cases that at times result in um, multi-million dollar verdicts, um in terms of the rationale for this particular, rationale for this particular case, um the rationale regarding the recommendation of settlement. Um it it's based on a a number of factors the first Factor being that um, our Sergeant does say that he was told at the scene, um that by a witness that admittedly we do not and have not identified that um, he struck the plaintiff in addition to that the plaintiff was transported from the scene from the rat. was transported from the scene from The Radisson Blu Hotel directly to the emergency room. directly to the emergency room and at the emergency room. Uh, ah, ah, uh, uh medical treat or a doctor in the ER said that he observed her to have redness and swelling. observed her to have redness and swelling on her foot. So, um indications, uh, um indications, uh that she had been hit or run over. and then finally the recommendation is based on um comparables that we have seen in other types of cases with complex Regional complex regional pain syndrome. Um, particularly, uh, there's a case with a 52 year old, um individual who sprained her wrist in hand, um, and the jury awarded 2.6 million dollars for it. million dollars verdict for that individual with the same treating doctor. Um, another just 1 more calm 4 individual. Um, who was hit by individual, um, who was hit by a dolly and suffered a cont. A Bros similar to this plaintiff. Um A Bros similar to this plaintiff, um, a jury rendered a 10 million dollar verdict. So, um the million dollar verdict. So, um, the recommendation is based on comparables in this matter based on the amount that's actually been spending on her or expended on her medical bills and the fact that um, There is Doc. there is documentation of both, uh red There is documentation of both, uh redness and and some sort of injury to her foot. Um immedi. sort of injury to her foot. Um immediately after the incident in the emergency room. Did she drop a book on her foot or? just it seems like a fairly weird weird set of facts and extremely uh what I'll call a a nuisance. extremely uh what I'll call a a nuisance, um more or less, uh settlement for some facts that that that don't definitely put Definitely put the sergeant in. in in in a in a position where he or she uh can be proven to have done this that that's that that's that that's all. that that's all I I I I'm troubled about it, but I I'm troubled by that but uh I don't know if I'm willing to uh Gamble with uh, somebody else's money. So sure, so the the only thing that I Sure. So the the only thing that I will just add in highlight is that our Sergeant does? highlight is that our Sergeant does say um while he was on the driveway he the driveway, he was informed by witness that he had hit the plaint. the plaintiff's foot. Um, and based And based on that as well as the medical evidence. That is why the Department of Law is making this recommendation. but I of course understand your your hesit. but I of course understand your your hesitancy and uh trepidation Alderman. Is this a state case trepidation Alderman is this a state case or this is a state case, okay? state case Okay, um, Okay. Thank you mad. Thank you madam. Chair. Um was that made at the time that she already had the expert witness saying that it was going to be 600 thousand. Yes, okay. so when we're looking at and then the other comps that you talked about the 1 with the wrist and the bruise, um were those versed? those versed the versus the city or were those out there in the Sure, so 1 case. Sure, so 1 case where there was the 10 million. Sure. So 1 case where there was the 10 million dollar verdict was against. Give me 1 second. Um, that was the wrist 1. Give me 1 second, please. Um Okay, so Give me 1 second, please. Um, okay, so it was against Walgreens pharmacy. Walgreens pharmacy and um that matter was pertaining to an injury on her. cap Okay, that that was the bruise then. okay, that that was the bruise then yes, but yes, okay bruise both of them both of the matters that I'm well 1 was a bruise and 1 was a sprained wrist. Okay. 1 was against Walgreens. 1 was against Walgreens and the other was against not against the city. No, it was not against the city of Chicago it was Chicago. It was against Global Experience special. Chicago. It was against Global Experience Specialists. Um They were hosting. They were hosting a medical conference. Bad place to get a bruise on your wrist, I guess. Um. so when when we looked at those 2 So when when we looked at those 2 as cops. Did we get a second medical opinion? Um from any? Did we get a second medical opinion? Um from any of did we hire an expert to say? um You know because there's 2 things here. You know because there's 2 things here first you have those 2 comps are in on. 2 comps are in on the basically private entities. You know the I don't know who the local. you know the I don't know who the local medical experience thing is, but Walgreens, obviously we all know. um sounds like they settled once they got the actual settlement request because ours is at 12 million for something similar and we got it down to 400 which I think is an excellent job. But did we go? But did we go out and get our own? medical opinion or our own medical expert to say uh and and I don't And and I don't know if you had the complex Regional. Um pain syndrome expert in those other 2 prior comps but Did we challenged that at all with our own second? Did we challenged that at all with our own second opinion? Yes the city of Chicago. Yes, the city of Chicago did retain an expert in this matter. Um, and the settlement is the settlement proposal is based on the department. is based on the Department of Law believing that it is the most econom. most economic resolution for the city of Chicago. Um, because we are proposing a settlement which is only inclusive of the current medical bills. It does not include any future medical bills that the plaintiffs have most certainly would be seeking at trial. with the backing of um an expert who helped to develop this An expert who helped to develop this diagnosis, it does not include pain. include pain and suffering both past and future loss of adorable life. adorable life both past and future um in adorable life both past and future, um in any disfigurement claims that might be brought based on the spinal. claims that might be brought based on the spinal stimulator that is um implanted into the plaintiff's back so we did consult with um an expert. Um, there were multiple doctors that were deposed in this matter. that were deposed in this matter and the recommendation is based on what we believe. based on what we believe is the most economic, um econom. economically Sound Decision for the city of Chicago in matter. Okay, and then the last question is do you think it sets a precedent for future nuisance suits like this? sets a precedent for future nuisance suits like this to settle in similar fashion? Um, that's a question that I'm happy to. Um, that's a question that I'm happy to answer, uh through the chair. I I do not feel comfortable. the chair. I I do not feel comfortable or pining on that in a a public forum. Even though we're voting on. Just that thing. But that's okay. I'll we can hold that. Thank you chairwoman. Thank you. Um, Miss Casey, uh, is it? information we can give in this setting about the number of uh doctors that opined on uh complex regional pain syndrome Uh complex regional pain syndrome. Yes, and this in this particular case. Yes. I'm happy. particular case. Yes. I'm happy to provide that information. in this particular case In this particular case there were a total of uh, 6 doctors. that opined on complex regional pain syn. that opined on complex regional pain syndrome both doctors that um were retain. that um were retained as experts as well as doctors that um treated the plaintiff. And the majority of them. and the majority of them, uh opine that she did suffer from uh complex regional pain syn. uh, complex regional pain syndrome, which I've never heard of before. this case alderman laspada Thank you very much cheer. I I will. Thank you very much cheer. I I will admit that I shared a lot of the the kind of skepticism that we're hearing from in the room and I think room, and I think what helped Me get on the side of this. Me get on the side of this is not only knowing what those comps look like. comps look like how well our team has worked. comps look like how well our team has worked to argue things down. but thinking about this diagnosis you But thinking about this diagnosis you do not agree to SP. surgery to a permanent implant for something that is not serious. That is a a a quack diagnose. not serious. That is a a a quack diagnosis. So to speak to someone does not pursue that seriousness of treatment unless it is a real and Grave and Grievous. it is a real and Grave and Grievous injury, and so I understand the seriousness of what we're dealing with and I'm glad that we're able to bring what I feel like is an extremely reasonable settlement given the circumstances. extremely reasonable settlement given the circumstances of if there's not further questions. This case involves a police pursuit in which an innocent civilians? civilians car was struck by a car fleeing from officer. Michael. plane of Tony Pearson had pelvic surgery as a result of the accident the Department of Law recommends settlement. accident. The Department of Law recommends settlement for this matter in the amount of 42. this matter in the amount of 425000. on November 8th of 2015 officer Michael mcgurn observed On November 8th of 2015 officer Michael mcgurn observed a Dodge Charger. He mistakenly believed. Dodge Charger. He mistakenly believed was taken by force in a car jacking in. a car jacking. In fact, the Dodge was not taken by force and was merely stolen. after attempting to stop the Dodge it accelerated away at a high rate of speed the Dodge fled for approximately 1 minute over half a mile at a top speed of 65 miles per hour. finally at the intersection of Finally at the intersection of Laramie and Madison the Dodge struck. Dodge struck a car occupied by plaintiff and innocent civil. civilian. the plaintiff alleges that officer mcgar willfully and wanting pursued the Dodge at excessive speeds. The plaintiff was taken from the scene. the plaintiff was taken from the scene to the hospital by ambulance having suffered a fractured pelvis requiring surgery. His total medical bills are $9,000. at trial a jury could award plaintiff damages for a and future pain and suffering past and future. and future pain and suffering past and future loss of normal life disfigurement and medical. normal life disfigurement and medical bills the Department of Law recommends. of Law recommends settlement in the amount of 42. of Law recommends settlement in the amount of 425,000. Um thank you madam, chair, um in in settlement discussions, uh was there any uh, was there any uh analysis of the percentage of liab? liability that the driver of the Dodge would uh, be resp. responsible for the driver, um of the so let let me restart that. Um, there were a number of uh, juven were a number of uh juveniles that were detained subsequent to the at uh, the accident. Um, To my knowledge there is not evidence in the record. I identifying which 1 of the juvenile. identifying which 1 of the juveniles was the driver of the car and on top of that. Um, uh, we would not be naming. juvenile a as a codependent. So that was not a part of our our analysis in this case. okay, uh and you mentioned that the Okay, uh and you mentioned that the Dodge was in fact stolen, that is correct. And and the that is correct in in the officer was aware that it was stolen when he made the pursuit decision. Sure. So the um, background information on on on this case is that um background information on on on this case is that um, the officer The officer believed that the car was taken in a vehicular. hijacking, um based on a earlier. hijacking, um based on a earlier, um dissemination via the radio. radio, um later a separate officer determined. radio, um later a separate officer determined that in fact after speaking to the victim that in fact the vehicle was stolen, um, not by force, um that information stolen, um, not by force. Um, that information was input into the CPD. into the CPD computer, um and prior to starting the pursuit. the officer ran. Um, the officer ran, um the plate of this vehicle and the CPD computer that results said that the vehicle was stolen. However, the officer did not review the computer. However, the officer did not review the computer result prior to and during the pursuit. So he pursued thinking that the car was hijack. that the car was hijacked when in fact it was stolen and how is that relevant to this? how is that relevant to this case the way that is relevant to this particular case? to this particular case is um Chicago Police Department purs Chicago Police Department Pursuits our governed by the general order, um at the time of the pursuit. Um, general order, um at the time of the pursuit, um, the general order would have well, let me let me restate that. Um the general order Um, the general order may have viewed. Um, Um, the general order may have viewed, um a pursuit of a carjack vehicle. carjack vehicle differently than the a pursuit of a stolen. vehicle. and And that would have some bearing on the determination of liab. liability. Um, it may have an a jury may consider that. Um, it may have an a jury may consider that information and determining liability. Okay. All right. Thank you. determining liability. Okay? All right. Um, Define proximate cause is as a cause, uh, of an accident it doesn't have to be the sole of an accident. It doesn't have to be the sole cause um, according to the pattern jury instruction. according to the pattern jury instructions. Um, or even the most recent cause it just has to be a cause so um, most recent cause it just has to be a cause so um when we try Why these Pursuit cases? Why these Pursuit cases and I I have tried a number of them when we tried these Pursuit cases. when we tried these Pursuit cases, um the plaintiffs argue. um, and at times successfully ARG argue, um, and at times successfully argue that the officers, uh, officers uh decision to initiate the pursuit. decision to initiate the pursuit, um was and is a proximate cause of the accident so to your your specific question, um our officers testify that um, approximately 2 blocks, um before the accident they began to slow down. Um, before the accident they began to slow down, um in terms of the proximate cause the of the proximate cause the plane to certainly will make the argument and the jury May potentially find that even though the officers were starting to slow down their decision to start a Pursuit and continue to pursue was a proximate cause of that accident. Um, how it may have been um a little different with regard to a vehicle Pursuit with um a a possession of a stolen motor vehicle or vehicle hijacking. sure, so I'm happy to um read and then um provide a bit of color to the relevant Pursuit policy. color to the relevant Pursuit policy in place at the time of the accident. Um, so at the time of the accident the pursuit policy in place was go 30302 01, um, it was issued in April of 2003 and then rescinded in March of 2016. So it was in place at the time of this accident. Um, and the policy specifically says prohibitions, um, the continuation of a motor vehicle Pursuit is prohibited wherever the most serious offense of which the pursued Vehicles wanted is either a theft. Um, and the pursued vehic either a theft, um, and the pursued vehicle disregards the traffic signal signals. traffic signal signals or signs when entering an intersection, so certainly in this matter, intersection, so certainly in this matter the plaintiff will argue that um, will argue that um the that the pursuit was prohibited Because the vehicle was stolen. Because the vehicle was stolen and um the vehicle Des. disregarded a traffic signal that is the argument. disregarded a traffic signal that is the argument that the plaintiff will make in this case based on. plaintiff will make in this case based on um the in effect Pursuit policy. Our last settlement is settlement 8 D which is foresting Williams and independent as an independent administrator for the estate of Martina Stanley versus the city of Chicago. Stanley versus the city of Chicago officer, Brian Greene. uh, 43.25 million. Thank you chair. uh this Uh, this is a state court matter in uh if the settlement is approved by uh committee and is approved by, uh committee and Council it will resolve all claims against both the city as well. all claims against both the city as well as its named employees. Officer Brian Greene was stopped at an inn. Officer Brian Greene was stopped at an intersection in his squad car when he noticed Mart. squad car when he noticed Martina stantley beating on the right side of his vehicle. He turned his steering wheel to the right and slowly turned his car into Miss Stan. his car into Miss Stanley causing her to fall to the pavement. pavement and strike her head. after attempting After attempting to shift his car officer green got out. after attempting to shift his car officer green got out and found Miss Stanley's leg under the wheel of the car. as a result of the As a result of the incident Miss Stanley suffered a traumatic brain. traumatic brain injury and showed signs of cognitive ISS. for 2 years before she died of drug. for 2 years before she died of drug toxicity. the Law Department recommend The Law Department recommends settlement of this matter and the amount of 3.25 million. on know on November 13th of 2019 officers Rachel pumori and Sony Castro approached Miss Stanley in a parking lot at 71. Street in Jeffrey Boulevard. Miss Stanley reacted aggressively made threats and then quickly shifted to flirting Miss Stan. quickly shifted to flirting Miss Stanley then walked out of the parking lot. Approximately 30 minutes later a business owner. Approximately 30 minutes later a business owner called 911 and reported that Miss Stanley. and reported that Miss Stanley was inside his store spitting and threatening to break. spitting and threatening to break windows. officer green responds to Officer green responds to the scene and look for Miss Stanley in his car. about 5 minutes later About 5 minutes later officer green was stopped when Miss Stanley walked. Stanley walked toward his car shouted made vulgar gist. Stanley walked toward his car shouted made vulgar gestures and banged on the police car before starting to walk away. officer green took his foot off the brake while the Scott car was still in Drive causing the car to move forward. at the same time Miss Stanley returned to the car grabbed the spotlight and was hit by the squad car. She fell to her. ground fell to the ground striking her head on. ground fell to the ground striking her head on the pavement and pinning her leg under the car tire. Miss Stanley's leg remained pinned under the squad car for approximately 8 minutes until paramedics arrived on scene. the The plaintiff alleges the city of Chicago through its police offic. police officers was Will were willful and wanting and neg. negligent and interacting with Miss Stanley. negligent and interacting with Miss Stanley causing her brain injury and wrongful death. officer green drove into Miss Stan Officer green drove into Miss Stanley knocking her to the ground and causing her to suffer. ground and causing her to suffer a brain injury. Miss Stanley was taken. Miss Stanley was taken to the hospital and diagnosed with a traumatic brain. traumatic brain injury and fractured leg. in total In total she was in in impatient care as a result of this. accident for 6 weeks. on January 30th of 2022 approximately 2 On January 30th of 2022 approximately 2 years after the accident Miss Stanley was found. accident Miss Stanley was found dead as a result of drug test to toxicity. test to toxicity for 2% prescribed mental health medic. medications. if this matter were to proceed to If this matter were to proceed to trial a jury could award damages for wrongful. damages for wrongful death and survivorship for the 2 years. Miss Stanley lived with her brain injury. the department The Department of Law recommends settlements in this matter in the amount of 3 million dollar 3250 dollars. no questions on this 1 All right.
