They don't mind making a, mockery of us by standing there, laughing and talking when we're here to uh express our public comments. Why? Because he's racist He's disrespectful. And so he's going to go ahead and do business because he understands the dynamic of the Democratic Party. And the Dynamics of the Democratic Party. Is to make sure that you keep a group oppressed which is us to keep us disrespecting. If you can get the preachers to go along with you like Hall. You really in there. You really in there, when you can get the black Alderman, not to stand up and talk and not to uh, stand for us. Not to demand our money, y'all in there, and it gives them the straight, go ahead and the mind space and the Heart space, and the, and the Soul Space to come in here. And talk all around us about our community. It gives them the mindset to tolerate a Rosa to still be a part of City Hall. The fact that anybody would still do business with him. The fact that anybody was still observed him, as a older person is downright hideous. And it proves how less respect that these developers. It's actually the largest upzoning of any of your spot zonings and today's agenda and it has 1 purpose and 1 purpose only, which is to bail out and overhead property oh over or underwater property owner uh and to ensure that his developer buyer, uh, has a profitable project regardless of regardless of the impact on the surrounding, almost uh, RS3, uh, residential area and um, I'll let the uh, I'll let the, uh, other members of the community, uh, fill it in beyond that, but there's no purpose for this other than to, Bail out uh 1 connected uh property owner, thank you. Uh, me Miss. Zoe Uh, Happy New Year. Uh, couple of things, I see this, uh, 17th Ward. Ugh, 774 1174, 47, South Hollister, which is a couple of blocks down from the building. That was uh, not unlawfully demolished in my uh, in the ward and this uh uh, I've been trying not to curse this year but uh, This piece of crap, uh, uh, Ward who uh, is terrible. But I I I take it. This is you um, just want to let you know that, um, I I know what y'all are doing that whole hosted. Uh that's the main reason why my uh, building was unlawfully demolished and still have not been paid because it was a whole 10 year plan to fix that hole. Um, that whole uh, uh Avenue uh, because y'all want to do the affordable housing and mixed income and all that thing, because y'all trying to push, uh, all blacks out to the suburbs and stuff like that, you know? But, um, as you see in California, it's burning right now, La is burning. Because God is mad. And God is mad because y'all continue. To do what y'all are doing to people. And y'all think that y'all are going to continue to get away with this. Now, I'm going to the inauguration next week, okay? I've always been on the federal always fought for the federal. That's why I start coming down here because I try to get help from the federal. Then I went down to the state, then I went down to the local and then once I seen that, you guys were not going to do anything then I decided that we have to change Administration so that's why I went red and um with doing that I'm working with the Republican party and I'm working with the Republican party because I'm determined to get the feds involved yesterday, we went to Madigan's trial, I went to Madigan's trial, listen to it, you know, understand Whole land, transfer thing. Um, as my man who, um, has opposition and what's going on in your ward. If I were you, I would do what Chinatown did. And what they did was go get what 3,500 signatures and stuff like that and that's why they couldn't do that land transfer situation and then all of a sudden all a can of worms opened up. So that's what I would do because Chinatown don't take none of this because at the end of the day there are business and they know that and they know how much money they come and bring in Chicago and all over and every Chinatown all over the United States of America. That's their generational wealth. That's how they can help their family come over here. That's how they can come bring. But money back over there. That's why we do so much business with them, but when it comes to us, it's a problem. Just like what you knock down my building. So, I'm determined to figure this out and I promise you this. I'm fulfilling a term. I'm I'm, this is my second year, coming down here, right? It's my second New Year. I am not playing with y'all. I am not playing with y'all at all. Thank you. Uh, Grant. uh, I'm sorry, I apologize. If I say your name. Wrong Duchess, thank you. I'm here to speak in opposition to the 1239. Northwood proposed ma ma map Amendment. I'm president of the Wicker Park committee, vice president of the Wicker, Park advisory Council, uh, former chair of the cell 2 LSC. And at PTO, I president of the PTO I've been involved in the community for a very long time, and I'm here to voice concerns that the community members as a whole have to this significant upzoning and expansion. Uh, I've submitted in connection with the written submissions, a zoning map that shows that the 1239 Northwood current RS3, zoning is Consistent with 80 plus percent of the residences in that area, it's a small community, beautiful little worker Cottages that are all. If this map Amendment goes down, and the zoning is allowed will uh, that will be. We this will be used as precedent to get similar. Zoning exceptions for the rest of the properties there, and we'll see this historic neighborhood, trashed, as a result of this project. Um shortage of parking spaces on the property is is a big concern. There's no permit parking in the area. So therefore the the individuals who have cars who live in this space and don't have parking spaces are going to be further congested and already congested area. The unattractive materials that are being used for this project are just kind of ridiculous, frankly, and probably, most importantly, the, you know, the developers repeatedly attempted to portray this to the public as a completion of a fourth floor and expansion. In fact, this is a 3 floor building where the previous owner put on a roof deck and a greenhouse on the roof deck and they're now trying to argue that that's a fourth floor and they should be allowed to build residences on the fourth floor. There are no current residences on the fourth floor, fourth floor, or wherever anticipated for the fourth floor, based on the the previous, uh, amendment that was allowed nearly 10 years ago. So, this RS3 Zone Zoning, uh, map change to. I think it's our of 6 Plus is going to cause all sorts of issues for this particular neighborhood and we're going to see a destruction of the look, the feel of this neighborhood, which is part of what makes Wicker Park, really tremendously unique, and what causes people to want to stay in this city and and and maintain the tax base. There's certain a lot of development going on around the perimeter Division. Street Milwaukee Avenue. The Arteries have got high rises mid-rises, that have been growing going up there. There's, uh, there, there's subsidized housing going in there. There's all sorts of opportunities for, for building in the area without destroying the fabric of this particular. RS3 neighborhood. Thank you. So, we have Ryan. F uh good morning everyone. Uh, my name is Ryan Fant uh I'm a resident at 173, West Crystal Street. Um I've lived there since 2016 with my wife, um and we've lived within 500 yards of that property since 2006 with a small layover in in in Manhattan. So we're very familiar with the area. We love the area, we continue to plan to live in the area. Uh, I'm uh, opposed to the perso proposed um, upzoning at 1239. North Wood for a number of reasons. Granted, uh, highlighted a few of them, but um, this pocket from Walcott Walcott to Milwaukee to division is a, is a, a very kind of Unique Piece of worker Park in the greater Wicker Park about 10 area. Uh, that is zoned, RS3. If you look at Ukrainian Village, if you look at other areas of Wicker Park, it's all rt4. And I, I don't, I don't have a history lesson, know why that is, but when I look at this little triangle area, it's a lot of Smaller, Lots Cottages as as was. Um, mentioned lots of 1-way streets. Properties. With, no, alleys, I could point to 6 or 7 are There aren't even enough room in the street for 2 cars to pass by each other. So, we're talking about, adding all this density to this space, which just doesn't make a, a lot of sense to me. Um, The we've repeat and, and I'm the same page as Grant. The developer continues to portray this. As a completion of the fourth floor. I'm very familiar with this property. I've been through it many times. I know the previous owner the 80 plus percent of the top floor is outdoor space. So it's for the developer to continue to say, we're just going to complete the fourth floor. And then add this new structure I think is, is misleading and disingenuous to the, uh, to the community. Um, I I do want to make it clear. I'm not opposed to Redevelopment of this property. I'm not included a post to increase in the density, I just think the current proposed, uh, is zoning increase to rm6, is, is a, is a significant overreach and would and once again oppose the uh the change. Good morning to the committee and thank you for the opportunity to speak. Um, my name is Bill Benton, I'm a resident in the First Ward. I've lived there since 1995 rented, their, um, lived in multi family housing and also live, uh, and, and I'm a neighbor of Ryan, uh, 100 feet from the proposed up zone of 1239 Northwood. Uh, this is a historic building. It was originally a Jewish orphanage uh to which a lot of children after World War II came to Chicago. Um, it's a beautiful piece of architecture. It has a large open courtyard. Um, like Ryan, I am not opposed to increased density or multi family housing. I've lived in it, I appreciate it. I live in the city because of density and appreciate that. This upzoning is a massive overreach of what's needed. They're looking to install 26 units, um, in a space. That, uh, typically Would house 4 homes. Um so if it was 43 Flats it might be 12 12 units. So I think the, as Grant mentioned, the need for this uh, hyper upzoning is because the original owner intended to make a 14,000 square foot single family residence there 14,000 square feet. Put in a lot of money, got impatient and moved to California and gave up. And so you have this building, that's in the midst of an upgrade. And unfortunately, to try to minimize losses, they have to over stuff that property with enough rental units to make the return on investments sufficient for what's probably a private Equity Group. I don't know. Who exactly is developing it. We have been unable to work collaboratively collaboratively with them as we've been able to do with other Wicker Park. Developments Um, I've raised my kids here in the First Ward. I went to public school at South 2. Additionally, this is a tight block. You can't even have 2, cars, pass each other. So to have 26 units and 11 parking spaces. Also doesn't make sense. And if it is a mass transit location, um I don't understand why we can't have permit parking and disallow permits for this upzoning. So the entire premise of affordable housing, I think also will be controverted by the fact that a lot of these are airbnbs these days, which are crowding, out long-term residents, we have 1 at 12:30, I'm sorry. 1731 West, uh, ptoc next door to us, There's often parties there. We've had to call the police several times over the last year. This is not increasing affordable housing. That's a ruse. Um, out of time, thank you very much. Thank you. We got that. M, manufacturing districts. we have, uh, Almond Wags back is here. And we have all the wagons back here to present on this matter. Almond, Waggles back. Happy New Year. Um thank you for allowing me just a couple minutes to speak on this. Um a lot of us have been working on the shared housing, license ordinance uh with different amendments. Over the years um as the current shared housing, license ordinance allows licenses to be issued for all zoning districts that permit residential use. Um, I have been looking at it and saw that there was no practical reason for forcing legal non-conforming residential units. Zoned M to be resand in order to obtain a license. Um, if we were that if it were the case that certain residential zoning districts allowed, shared housing and others did not, there could be a rationale to support the need to rezone. Legal non-conforming residential uses. Um, so for example, shared housing licenses were only allowed in rt4 districts. And above a legal non-conforming, housing unit on a block, that was predominantly. RS3, should not be issued to licenced, unless the alderman was willing to rezone to rt4 Um and explain what? Why? That use was applicable to 1 lot and not others. Um but we saw no search circumstances exist under the current ordinance that there couldn't be a rationale for forcing. Rezoning of a legal non-conforming residential unit. Um, I've had multiple instances where Property Owners came in with a legal non-conforming residential unit zoned. M. Um trying to obtain a shared housing license and I think uh, along the river and a lot of our old manufacturing areas, I think that chairman you, uh, used to share with me or you know, that we know kind of exist in those areas. Um, it doesn't allow for, uh, The shared housing unless we do a zoning. Change for a broader portion of that area for individual. Uh M zoning, Lots. So um what we're looking at with this would allow for um people to apply for shared housing units in those M those M districts, where, you know, going back decades. Um, someone might have a residential home in an M zoning or an apartment house or something like that. And this would allow them to, uh, essentially create that shared housing unit. So, so this is to deal with the non-conforming properties in the M districts. Uh, it would be yeah. Essentially, we have legal non-conforming residential units that already exists, and this would just allow them to apply for that shared housing. And I think, um, I don't know if the zoning administrator was going to weigh in but I know we had conversations through my staff. Sure, that's true. planning the Caveat to the current text that exists is that such units have to have been registered prior to June of 2016. And that would be Uh, probably highly unlikely for a unit that is zoned M. So this allows for Uh easier registration. Going forward of these units that couldn't have most likely gotten the registration, because they were a residential unit in M District to begin with which most likely either was not established legally or has some other non-conforming issue to it, in addition, to the residential Factor. So, this makes it easier for those units to be, uh, designated for shared housing. Okay. Uh, any questions about the body? Uh you can see the property here it is, approximately 452 feet from Division Street. It is also about 500 feet from Milwaukee Avenue. Both of these are designated TSL. Bus lines, it is about 1,000 feet from the CTA Blue Line Station at Milwaukee and Ashland. It's also about 800 feet or so from the Ashland bus line. So there's 4 qualifying, teal, TSL, um, locations within the appropriate range of this property. The property prior to the exist. The current owner started to do. You can see the existing building on the right of the images. There's a new addition that's being proposed. That looks totally different from the existing building and that was on purpose. The uh the current owner bought the property started to build a fourth floor. Addition on the property, intention at that point was to do a 2 units. Plus a very large single family unit for him. That was about 10 years ago. He he was uh relocated to California construction stopped and it's been in that state for about 10 years. At that point it was zoned. Our m5.5 because of an agreement with the community. It was down Zone back to RS3 since that time. I think the alderman has has talked to many people about the Redevelopment of this property, uh, but specifically with an intention That the existing building get retained. It had get kept, uh, it's a larger building uh fits about at least 20 units. These are mostly 2-bedroom units so they're not small by any means. Originally, The Proposal that we took to the community was to make complete the fourth floor. That's partially built and add a fifth floor. Addition, the community had an objection to the fifth floor. Addition, we took the fifth floor Edition off the building, and then proposed an a 4 story addition to the side or east of the building that you see here. Um, we had 2 Community meetings on this property. 1 about last April and 1 earlier this week, uh, both hosted by the alderman, there were some people in opposition, you've heard from some of those today. There were some people in support, I let the alderman make the judgment on that. The proposal is to rezone the property to an rm6 District. We have rm5 across the street. We have rm4.5 kitty corner across the street. We have rm6 about a block and a half Northwest of this property. Basically, the RS3 doesn't fit the the building that's on the property and we can't have the development that would really occupy the space within that building within RS3. We have to rezone it to what higher District. The rm5 is, merely because once we put the addition on the side, the fur slightly exceeded that that would be achieved under the RM 5.5. Um, as I said, we've had 2 Meetings, we have made, modifications to the facade, to the size of the project. Uh, the 1 change that has occurred recently that I should note for the record. Is that we first of all we have uh, a few administrative adjustments variations that are part of this resoning. The first is to reduce the front yard from 15 feet to 11.8 feet, sorry, 11.18 feet. That's to accommodate essentially the setback of the existing building um and the rear yard Sorry the East set back to zero again. Accommodating the existing building, not the addition uh, which is set back from the East property line. Um reduce the parking from 26 basis to 10 as originally filed. That was 11 spaces in our community meeting on Monday. Community members asked for additional bike parking, particularly cargo bike parking spaces which are larger spaces because of that, we had to locate them in the garage and we lost a parking space. So now we're down from 11 parking spaces to 10. And then uh, variation to reduce the uh, the ESV, the electric vehicle charging stations to 20% and we moved the 1 existing loading birth. I will note that of the 26 units 5 will be affordable provided on site probably a 1-bedroom, a 3-bedroom and 3 2-bedroom units on site with that I am happy to answer any questions the committee may have Okay, first of all, uh, there's a substitute, I don't know. This item was voted down at the time. However, after further discussion with Alderman Waggers back, it was decided that there may be a path forward for this project. If the developer agreed to work with the community in the 302nd ward and if the developer could get a letter from the commissioner of housing declaring that the project meets the definition of an inclusionary application, which means that the project is within a mile of a CTA or a metro rail station and all affordable dwelling units required under the Aro will be located on site or 20% or more of the on-site dwelling units are subject to a recorded. Covenant liens regulatory agreements deed restrictions or similar instruments approved by the Department of Housing on December 18th. 2024, the developer received a letter from the commissioner of housing. The developer is also working with the 32nd ward in the community, surrounding the project including having a community meeting scheduled for next week. January 15th, 2025, a vote to reconsider in the items voted on in a committee can only occur at the same time. Same meeting or the next regular meeting therefore in order to allow the developer to continue to have these discussions with the community and the 302 war and give them time to bring the zoning map, Amendment back to the committee.
