How many times now, So I can only account this as what discriminatory because here it is Latin. Speaking, people have come into the country and have been given preferential treatment and got housing, I'm homeless still, but then I said they said every system, Works within you chairman. So the coordinator coordinated entry system works between you. So if I call and or if I get a HMI s number and that HMI s number is dropped out of the system by some chance. And I'm continuously calling over and over. Countless countless hmis numbers are dropped out of the system by some chance. I'm not receiving any shelter any housing but people who have come into my country. I'm 44 years in this country. So, you know what I said, I said, man, let's find out. What does this individual believed on? But then, what is it? You call me a fascist. So I the opposition to a fascist will be What communists or whatever it is. But I'm a demo. I was grew up in a Democratic party and a democratic country I was grew up in the democracy. Where we have constitutional laws rules and rights. What we don't we don't organ. I'm being treated like a foreigner by somebody in my representative a representative of mine, somebody should be taking care of me, as abusing me, has treated me poorly, but giving other people of, I guess like descent preferential treatment above me in my own country. Well, the bottom line is I know firsthand. That I can go to him because he can relate to the crookedness of the court system. Now, I have done everything in the courts. Correctly by law, and I know unequivocally hands down and people that sitting in this room know, hands down. That the Cook County is illegally trying to take my mother's building. There is no doubt. They have seen the documents. They looked at them. They've been in meetings with these people. And they refuse to persecute them, prosecute them. They refuse to make them stop. So, what choice do I have? You tell me what choice do I have? But to hope and pray that Donald Trump gets in office so that I can give him my documentation so that he can deal with Cook County and save my mother's estate. Because I've given everybody in this body, an opportunity to help me and Mayor Johnson and Tony, prickle can tell you all not to help me and you all don't help me. So what I'm going to do is go to who can help me. That man who life got almost taken from him. That. Yeah, that very very, very white man who had that red blood coming across his face when he came up out of that thing with the Secret Service. Uh, first I want to talk about the uh, 1 System initiative, um, that I understand is in Phase 1 right now, and I think that there needs to be a halt on that. Uh, first of all, combining, uh, homeless citizens, with homeless migrants into 1 System. 1 fund is just Just wrong on all accounts. Uh, first of all, a lot of the money previously in going to be spent before, uh, you know, after has has been arpa money is and which is earmarked for Americans. Money after that's going to be money. That should be used for American citizens and we're not doing that first. They're putting it in 1 pool so that you can use it for These poverty pimps your Coalition of poverty pimps that you call, you know, these nonprofits that come in and do this affordable housing, which I know you're about to pass or, you know, vote on, uh, uh, whether to, to fund, or let them buy or, you know, pay for, uh, the city laws to put affordable housing on. But if we look at What that does. A lot of people do not qualify for affordable housing as she as as we mentioned, it's a racket. First of all you're going to replace there's a black eraser happening in Chicago and when I say black eraser, I mean black foundational Americans. And I know you you you you all will put in afro Latinos and Haitians and others in our community and then tell us to all be 1 and that we're all supposed to uh have the same sentiment. And and that's not the case because you will cater to them first and all these laws and all these funds and projects will. Facilitate their needs while our people will be on the streets and homelessness. We need to understand too. Is this not just mean people sleeping on the streets? And it means people who are being displaced. It means people who don't have permanent housing who are couch, surfing, who, uh, are on weight list waiting for permanent housing. These are homeless people as well. They may not be sleeping on the street tonight or tomorrow, or next week, but they are also still homeless and you're not accounting for that as well. And that's mostly people in my community if we look at Southshore right now, this Mass immigration that you're doing and this like government funded Mass immigration and this Catholic, pedophilic charity funded immigration right now is displacing so many Southshore residents. So we see right now. Cko real estate is literally as we speak doing illegally evictions and threatening with arrest to the people so that they can hurry up and get this money that you all are putting out here for migrants and and other things that do not Help us at all. And so, this 1 system is not okay that that that is not going to work. That's not going to help the people who actually need it. The people who have been here, who have been on your wait list, they're going to continue to be on. Wait lists, we're going to watch other people move ahead and it's not okay. And, and to play on our emotions, you know, I'm, I'm, I grew up in Multicultural settings, my whole entire life. And I I hate that I'm in a setting that I have to pick and choose And my people. Oh, and the committee has received just for the record before I move on through written comments before yesterday. Um, now we can move on to the next order of business is the rule 45 report from september 11th 2024, which was email and handed out to committee members. The I I have it, the rule 45 report has been approved. Now, we will move on on the items before the committee item. Number 1 is ordinance 20240000002 547 restructuring of Home Alone. Agreement with Renaissance and look s l f, l p for property at 1501 West, Melrose Street in the 32nd World, Katrina, Collins from the Department of Housing is present to testify on behalf of this ordinance. Um, go ahead, the floor is yours. Okay, good morning everybody. Again, for the record, my name is Katrina Collins with with the Department of Housing. I'm a financial planning analyst, today we're going to discuss Renaissance St. Luke, Senior Living Facility. They have requested a loan restructuring which will um replace the current General partner and limited partner as well as a loan subordination. This 4-story, senior housing building is located at 1501 West, Melrose Street in the 32nd Ward under Alderman Scott. There are 107 units. 49 are restricted at 50%. Ami 46 units are restricted at 60%. Ami there are 12 unrestricted units, 2 of which are resident manager units. The project is still currently in its initial 15-year tax credit compliance term which will expire in 2025 the extended affordability of the term will not expire until 2040. The property is located at the corner of Ashland and Belmont on the south side of Melrose Street. In the next slide. Uh, the current General partner is rrg Renaissance St. Luke slf LLC, and it will be replaced by Green view, slf General LLC. The current limited partner is njk Venture LLC which will be replaced by Green view, slf limited LLC the limited partnership owner Renaissance St, Luke, slf LP will remain unchanged. The transaction is not a sale of the property, but it will allow the change of control of the ownership of the property and a sale. In the interest in the property, the purchase price of the GP LP interests is going. For million dollars. The letter of credit for bimo. Harris will expire in 2025 the proposed new owner has received a letter of credit from CIBC for up to 7.1 million, as part of the application, they are seeking approval to subordinate our loan to the new line of credit. Um and I should have mentioned the other. What we are subordinating our city home funds are worth 2.8 million and that will know nothing's changing to that loan. It just remaining in second place. So our requested actions today are 2 uh to approve the change in structure of the general partner and limited partner which will allow the sale of the interest in the structure for 6 million dollars. As part of the approval of the seller has agreed to make in an interest payment of 420,000 and the buyer has agreed to make a semi annual payment towards the recruiting interest. The second approval is, um, to authorize the subordination of the city's Junior, mortgage by approving CIBC as the replacement lender of the credit for the bonds that does conclude my presentation. The next item on the item number 2 is the ordinance 202400012550 cell transfer and Assumption of City depth, uh, from illis neighborhood Development, Corporation to vintus karibuni LLC, or permanent supported living facility at 8200, South Ellis Avenue in the eighth word. Katrina Collins also from the Department of Housing is present to testify on behalf of this ordinance. Okay, again, for the record, my name is Katrina Collins today. We're discussing Cara Boone, Place the property is located at 8200 South Alice Avenue in the 8th, ward under alderwoman. Michelle Harris, we have received a letter of support. The property is in the chatam community. Today, we will review the request for the approval of the sale and transfer of 1 Building located at 8200, South Ellis, and the approval of the Assumption of the regulatory. Agreement loan, documents and Assumption of the existing City debt, please note carbon place is part of the Heartland portfolio that consists of 12 properties and I'll discuss that shortly. Uh, the building is located on the southwest corner of Allison, 82nd Street. Shown is a list of the Heartland housing properties. Um, for anybody unaware in March of 2023, Heartland Alliance, which was apparent agency of Heartland, housing informed, the Department of Housing that their affordable housing portfolio was in distress and it risk of class the city along with other public, funders interests filed, receivership complaint and an emergency motion in court and general receiver was appointed to control the Affairs of all properties. The portfolio, underwent extensive review process, um, to begin restructuring activities for each building. And again, I think there's at this time, 6 of them are in process and we're waiting for applications for 6 more. The development team, the owner of the property is LS neighborhood, development Corp. It is a, it is proposed to sell to vent care who will serve as the property manager by an entity, um, to still be formed, Alice neighborhood. Development Corp was a tax exempt entity created by Heartland housing, Inc. To hold ownership interests in real estate projects. Dentist hold, this is an experienced expert in revitalizing and stabilizing distressed assets. And they currently have about 750 units in their portfolio throughout the Chicagoland area. the property is a 4 story brick building that houses a total of 72 residents. The property is um intended to provide permanent Supportive Housing with services, to formally homeless individuals. The building has a project-based voucher contract with cha that covers 121 bedroom units and an SRO mod rehab contract that covers 60 units. The contracts with cha are renewed their proposed new owner has been in discussions with Trilogy who will take over the social services provided to the tenants. These services These services will include case management employment services and supervision. The property was uh currently has a full-time case manager and social worker on site. As shown as the proposed scope of work, most of the scope of work includes routine maintenance that will be caught up on since the transition of being placed into receivership the funding of this scope of work, will come from the cash flow and the funds. Um, provided from the proposed new owner, they expect repairs to be completed within the first 6 months of ownership. As part of the purchase agreement, Ventus kabuni will assume all current debt, the city of Chicago has approximately 2 million dollars of Home funds that will mature in August of 2036 Ida, has approximately 210,000, which mature in 2035. In addition to the Assumption of the debt, the purchase price, totals a sum of 75,000 of which 50,000 may be used by the seller to pay any real estate taxes, transfer taxes and or closing costs then owed by seller is part of the purchase. It is agreed all funds accounts and Reserve shall include Shelby included as part of the sale. Uh, hey. and the requested actions bent to carbon is requesting that the city of Chicago approve, the sale and transfer of carbon Place located at 8200 South Ellis. Dentist, Caribou bun is requesting the city of Chicago approve, the Assumption of the regulatory agreement loan, documents and existing City debt. We still own the first building that we bought in East Garfield Park 12 years ago. Um we are Born in bred Chicago in, we want to be in Chicago. We plan on staying in Chicago, um, and we're very excited to be working and uh acquiring this property to continue its intended purpose of per permanent Supportive Housing, so thank you. Thank you, I'll do my Harris. Thank you chairman. Um, I'm really grateful to save this building. Um, I'm a single family community. This 72 units of housing is essential is essential for a community like mine. I have no cha housing in my ward. Um and so this is really essential for me to have housing for non seniors. Um and so an award like mine Um, it's difficult not for people in that Grid. It's the rental grid um and most of the buildings are privately owned um and many owner occupied. So I'm grateful to have somebody come in to take over. Keep that building beautiful. It's holding the corner. Um, I would never want to see that building uh torn down and so I'm grateful that to get the reinvestment and grateful for you all to come in and take over that building and continue to help some of the, the women in um, men that live in that building again. I'm grateful that this building does not have to shut down. So it's uh transformative to what it's done to the grid. Um, the managers of the property are simply amazing. Um you you don't even know anybody lives there. If I could say that with that many units, they do their great management company. So again, thank you. Number 3, Ordnance 202400001400, designation of 1565 North Clybourn Avenue as low affordability community. In the second word. Brian pearly, uh, Pearl pearl ring, uh, director of zoning and development for Alderman, Hopkins is present to testify of this ordinance, Brian. The floor is yours. Thank you, Mr. Chairman uh, Brian pelrine here on Alderman Hopkins, who could not be here since he is currently chairing. A committee meeting down the hall. Um, we're here seeking, uh, an introduction. For a little affordability Community ordinance for 1565 North Clybourn, which recently passed plan commission, and committee on zoning and the full city council. Um, the applicants, uh, who is represented here by Mr. Paul Shadel, uh, is seeking this tax break in order to provide a substantial affordable affordable housing in in neighborhood that really has very little. Um, I'll go ahead and turn it over to Mr. Shale to give some details and we have some slides for you as well. Just to explain. I know this, these types of Ordnance are still relatively new. So we often get some questions on these. Um, and also, uh, he can give you the exact details on the breakdown for AMI and such. Thank you. Good morning, Mr. Chairman again, Paul Shadel, with the law, firm of De Piper representing the, uh, developer of this site. Uh, as Brian said, the council approved, a plan development for this site. Uh, this or last month, it's October now, uh, there will be 79 affordable units on site which are 20% of the overall units in order to make that financeable the owner will have to Avail itself of the Illinois, State Statute, the affordable, Illinois statute, which provides that in low affordability communities. A owner can commit to the 30% affordability and receive a reduced assessed value. And that's why we're here before uh Alderman Hopkins uh has introduced the ordinance to designate this location as a low affordability community and we'd Respectfully, request your positive recommendation for that that, designation. And I'm happy to answer any questions about the project. Yeah. Thank you. Uh, I'll we have Alderman bagasse, uh, to start with Thank you, Mr. Thank you, Mr. Chairman, is this 1 of the first ordinances or or projects that are having this using, this designation. It's my understanding that that's the case. The state statute actually does designate certain portions of the city statutorily. So, for example, downtown is this is Linkin Park, so I don't know why the statute didn't designate it originally, honestly, given the demographics of that location incomes and frankly rents in those locations. But it does require that the location itself be designated. And we, we did have 1 other before this committee, a couple months ago uh just a few blocks away. But that was our first in the second quarter. Was it also in the second ward as well? Yes. Okay, cool. Um, of the affordable units, what are the sizes of the units? Uh, at at this point they they vary Alderman vas, um, they range from I will, I'm looking at the breakdown right now, which I think we may have in the materials that were submitted to you. Uh, the Aro units that will be 20% or sorry. 20 units would be Studios. 521 bedrooms 7, 2, bedrooms. And I don't know the square footage is I apologize. Okay, cool. Thank you. They will be comparable to the market rate units in size square footage. Got you. Thank you. Looking forward to supporting this project. Thank you very much. thank you, and just for the record, I understand this will be um, again, not only in the, uh, second war, but similar ordinances have been approved in the first war, 35th word and the 32nd word. So and then I think I had the next item, it will be in the 45th word. So, I think that there's there's precedent and I do think that, um, we would like to see how this operates in different parts of the city as well, Alderman. Um, Alderman Bernett. Point of information. So so So, what are you doing? You just using your Aro. Over here on this project or this the Aro. As part of the project, the the Aro does not change. Um, what this does is it changes the text? The property tax rate that the owners will pay for the first. What is it 10 years? Paul. Yeah. It's a it's very similar Alderman to the class 6B or for uh industrial projects or the 7B for commercial projects. In fact, it or class L for landmark projects, it reduces the assessed value for a period of 12 years which then not linearly, but translates to a reduction in the overall property tax and without it. Um you we just couldn't obtain private financing for a project at this location with 20% affordable on site. So this is the, but this is coming from the state, right? Yes. So this is just the state. So so we had to do that in order for this to happen. So, under the state, I thought that was automatic with the, it depends in some locations in the city. It is automatic. But there are some locations that were not when the statute was enacted, designated as low affordability communities, and the statute requires the municipal government. In Cook County, in this case, obviously the city to make that designation. Oh, so if you didn't do this, they just wouldn't get the tax credit correct without this was still just half affordable housing. Correct mandated to do the affordable housing but now you trying to make it so they can get out of that wanting of affordable housing in the area. They would have to do the affordable so they can they can get the tax credits. Well correct. Well I would describe it a little differently that the the tax incentive that's provided under this classification. The affordable Illinois that I think that's the name of the statute. Without that they can't get the private construction financing that they need to build the building. That's what makes it feasible. Exactly. But it's it's property tax. Not the and another yeah, is a follow up, just a point of information. You mentioned the incentives similar to Classic b7b else. Is the state incentive also renewable? Or is it a 1-time for 12 years? I can answer 1 Thing If It is extendable or renewable. As I know, you know, you would have to come back to the city to get that renewal approved by the city. Right? They could not get this unless they did that first and that's regardless if the tax credit expires or not correct or is renewed? Oh, correct, yes. What impact that would have on what we can collect is in property taxes. No, I mean I can ask Department of Housing if they've done that, but I don't think that that has been done. I can tell you what's been discussed in the context of the Aro. So the the uh, 2021 version of the affordable requirements ordinance um uh allows or requires developers to provide uh, as a baseline 20% affordability at 60%, Ami, but that percentage can go down. If the affordability level is increased, what we found is that now there are developers in these higher income communities who are interested in getting this tax credit. Uh so that um they can both comply with the Aro, by providing 20% of affordability at 60% area, median income, which is the standard under the state law as well. So uh, they are allowed to then both comply with the Aro and Comply with the state law and be eligible for the tax credit and uh, my recollection from when we were working on the 2021 Aro, is that the Department of Housing was very supportive of this because, um, it would, uh, promote more 20% onsite affordability, uh, as opposed to, uh, payment of inlu fees or or other uh, methods of comp compliance But uh, yeah, I'll look into getting a map. I don't think many areas are uh designated by the statute. So that's why. Um I think you'll be seeing uh more ordinances there may be. I can't really Envision it now, but maybe there's a situation where, uh, an all the person would not support the, um, uh, the tax credit. I mean, I can't Envision that now, but I haven't thought of all the scenarios. Yeah, I remember that. Yes. So I mean, Honestly this is my first time hearing about this lower affordability. Uh area. Can you can you tell us the history of that? The State Credit you mean, no, not the State Credit. Uh, these communities that have this have this low affordability, designations it, it really, uh, I believe the answer is that aside from the, the downtown area, uh, the state law, allows local governments to identify areas. Um that would be eligible this tax credit. No no, no, no, I'm talking about, I mean we're trying to change ordinance because you saying these the we we're trying to change this because you're saying that these communities are in this. This law affordability area. Oh, we're creating a lawsuit. Yeah, that's that's what it's called under the state law. Um, it's it's not it's really the state definition, the state designation. Um, that's why it's called a low, affordability community. So, so what I'm trying to understand. So, like, in my word, I have several buildings in my ward. They doing it. They getting the tax credits and they're not coming back to housing to ask for any type of relief. Like, like these guys are doing. What's the difference? Maybe I need to talk offline because I I'm, I don't understand. You know what I'm saying? I don't understand what this is and is this just in certain areas that this has to be done. And and I'm saying why is it in certain areas why in certain areas this have to be done. Okay, well, let's talk offline. Why, why why it happens in some areas and not in all areas. We'll get that also through the, I'll remember information, but because I want to think we're forgoing Tax money. When we maybe we don't need to property tax money. That's a good question. Something that would be good to have an analysis on that as well through the Law Department. Yeah. Thank you, Mr. Chairman I I just wanted to respond to my colleague on the left here. This whole initiative was put forward by some of the developers that were having a hard time meeting. The 20% affordability, because the deals were in fencing out, penciling out. And so, what they did was, they went down to Springfield and was able to convince the general assembly as well as the governor to put forward. This tax relief property tax relief as an incentive, in order to make the deals pencil out. And so they provided the opportunity for the local municipality, the ability to designate areas. So that way it wouldn't be blanket because in some cases, maybe it fits, maybe a dozen. So they allow that that flexibility by the council member the local council member to determine whether or not they want to participate in the low uh low for low affordability um Community ordinance. That sounds exactly right? Yeah. Uh, the low affordability, communities would be. I think they use that term because their communities, where there's not a lot of affordable units. Because it's a, uh, a a high rent area. Okay? And the uh, the construction costs are higher. All right. and then we'll definitely make sure that we we have an analysis maybe as as some of the elements have requested in terms of the impact and perhaps, you know, um just maybe there's an a possibility of a, of a policy change so that Yeah. Yeah. I think, uh, Department of Housing is aware. Yes, okay. So we'll, we'll, we'll make sure that we report back to because I know there's a few few pending questions, Vice chair. Mitchell has a another question, actually, a more of a more of a statement. And this is to my colleagues. Before we start talking about anything that blankets City of Chicago, I think in a thorough analysis be. I don't believe in Chicago has different Dynamics to each community. So, so if you're if you're if we're, if they're taking advantage of this program, that means that They they would have had an opportunity if they wanted to to pay payment payment and Lou of participating in the affordability, is that accurate? Yeah, I mean, we can respond. There's a microphone next just for the record I can just There will be an impact on inlu fees in the sense that, uh, that uh, the state law requires on-site affordability, right? Right. Right. So there so there will be it. The more developers that take advantage of that tax credit, the less money will go, um, into the, uh, um, you into the, uh, low-income housing trust fund. Yeah. That's what I was getting at. Okay. Thank you. That is that is an important consideration. So maybe we can work with do and law. Well, it's interesting because sure, uh, definitely it's all policy related, uh, the city for a long time. Has been trying to, um, uh, incentivize developers to build affordable housing, rather than pay into the fund. It's just, you know, there is definitely an impact in that the fund was used to subsidize individuals and renting, um, units and the less money that is in the fund, the less money there is for that. So there's a trade-off but developers are now doing in addition to this tax credit, the 2021 Aro provided fewer opportunities to um provide inl fees more requirements to actually construct units. So, um, there, so the in the the the low income housing trust fund, doesn't get as much money as it did in the past. But there's more on site affordability and now, especially because now we have 5. All, you know, 5 words that are now, you know, entering into these um, low affordability areas. I think you'll be pertinent to discuss the impact that this could have, especially low-income house fund. I don't know. The trust fund, not sure what kind of projections they're making and that could have an impact on their operations as well. All the member net. Yeah, I think Paul shaido. Uh, wanted to correct something that he said if that's okay. Thank you, Lisa. Sorry about that. Thank you Alderman. Um, I just wanted to be clear. I, I missed described the mechanics of the incentive, and I think it may help this conversation, this broader conversation. And I'm just speaking as Paul Shadel, from dla Piper, not on behalf of any client in particular, the way the incentive works is, it's not the same as the class 7. It's it it comes through its state law, rather than the county code. So it's a state statute and what it does is it allows the municipality to, in this case, you know, approve a reduction in the increased assessed value, that results from new construction, or rehab. So, if I build a brand new building, obviously the value of the property will increase dramatically and that the assessed value will increase along with that. And of course, the taxes increase. Also, what this the low affordability, Community incentive allows is that for the first 3 years after the building is placed in service that increase in assessed value is eliminated. So it stays flat for the first 3 years. This is all assuming that the owner of the building agrees and Records a covenant ensuring affordability for 30 years. And as Lisa misher said, that that affordable affordability be provided on site. then in years 4 through 6 that reduction that increase is reduced by 80%. And then in year 7 through 9, it's 60% years 10, through 12, it's 40% and years, 13 through 30. It's 20%. So it's a graduated increase to the value for assessed value purposes. So, that's the mechanics. It does not work. Like the class 7B are the class 6B. I apologize. That was an error. Thank you for the point of, I'll remember that. Yes. So so I think my question was because as, you know, I have A bunch of these coming down, especially with Joe, uh, organization coming down the road. Do all of those guys have to come here. Every development that that every development that's applying for this for this. But it's tax credit have to come before us. It depends on the location in the city and miss misher and the department can probably answer this better but that's what I'm trying to understand. What does the location happen? There are certain locations that are clearly low affordability. That is their expensive, the rents are high right but that they are not designated as low affordability. So if there's a location that is not designated as I think the 2 before you this morning, they're not designated but they are in fact low affordable. There is still a Formal step that has to be taken and I can't speak for the general assembly, but I assume it was put in there to allow the local municipality to exercise some discretion. They then have to be designated by you. Yes, so that's only mostly on the North side. Yeah, you get the mapping the man. There's a map in the census. Correct? Yeah. And he's bi Dum by census tract. Um, Yeah, we can get we can make sure that we have a copy with um, you know. making sure that you, you, you're able to um, To see the map more clearly, because I know it's a little hard to see in the screen. but we'll make sure that you get a A digital copy and with the Departments. Appreciate it. uh item number 5 is ordinance 2024 - 0012425 amendment to Municipal Code chapter 2124, ending process of submitting, Acquisitions, dispositions and change in use of City on to Chicago uh plan commission and a Community Development commission, team Jeffrey from the Department of planning And development is present to testify on the card of this behalf of this ordinance him. Yep. Good morning. Chair Lopez and members of the committee on housing in real estate for the record. My name is Tim Jeffries managing, Deputy Commissioner in the department of planning and development. I'm here today to request your approval of 2, amendments to the code that will primarily modify the overall review and approval process for the disposition of city-owned land. Uh, specifically, the amendment would result in certain projects, no longer being subject to review by the Chicago plan commission or the Chicago, or the Community Development commission. Uh, the purpose of this is to expedite the development process and address 2 strategic changes identified in the cut the tape initiative. The first of these changes affects plant commissions, review of Property Transfers by the, by the city and sister agencies. Uh, the current practice of the city is for plant commission, to review the acquisition and disposition of land as well as, as well, as any land, use changes by the city and sister agencies in a manner. That is generally in, conformance, with the state's, inter agency, referral act, which requires review and approval by plan commission, uh, that however, is not legally required. Given other powers granted to Chicago as a home rule municipality. Uh, in order to clarify this discrepancy, the proposed amendment will affirm that these items are not subject. To the inter agency referral act, and are therefore also not subject to plan commission review in total. This would eliminate plan commission's review and of an estimated 5 to 10 items a month. Uh, I'll note that this change, would only eliminate plan commission's role in the process and that Acquisitions disposition and land use changes by either the city or sister agencies, will continue to remain subject to city council review and approval. uh, the second change is a focused on the Community Development commission, or CDC about the fulfills requirements. Outlined in the Illinois tax increment, allocation redevelopment act or the Tif act uh to have a community-based body review and recommend approval to City Council of certain actions within a TIF district. Uh as it relates to land sales. The city's current practice is to have CDC review, the disposition of all city-owned land within a TIF district. Even if that is not required by the Tif act. Uh, this is in part because of language, in section 2, 124 of the municipal code that is unclear regarding which projects are subject to CDC review. Uh, to address this, the proposed ordinance would amend that section of the code to better align with cdc's primary function. Uh, the result of this change would be the CDC would review the disposition of cdio and Lan, uh, when it either 1, uh, is identified for acquisition in a Redevelopment plan 2 is initially acquired by the city using Tif funds and then subsequently sold or 3. Uh if the disposition of property is part of a project, uh, that is also receiving Tif funds. Uh, overall, this is a expected to result in a reduction of approximately 60% of the items currently subject to CDC review. Uh, similar to the first change. I'll emphasize that this amendment revises only cdc's role in the disposition process and any item impacted by the ordinance would still remain subject to city council review and approval. Uh, overall dpd is supportive of these proposed changes because we believe they will result in an improved and a streamlined development process. Uh, and when combined with other efforts identified in the cut the tape initiative, we believe that they will significantly improve the development process and most directly benefit projects in Chicago's neighborhoods of greatest need. I'm supportive of uh this uh cut the tape initiative. Just want to ask the question your the our notice says here, Acquisitions dispositions and changing use of city-owned land. Can you explain what the last item is? How that's reflected in? The the uh, Acquisitions disposition discussion that you just had uh Lisa can can correct me if I'm wrong but I believe this is, if there's a zoning change it just it it, we're changing land. Use that would be subject to any of the normal processes. So Currently in the planning in, in the plan Commission. Zoning changes are part of the PD process, right? Right? It's uh again, I'm Lisa misher with the city Law Department, the change in use text, um comes from Uh, a state law called the inter agency referral act. It's this, it's this very short law. I don't know when it was adopted, but um, it it's the basis for, um, The city uh, plan commission, reviewing. Uh, or approving recommending Acquisitions dispositions. And it actually says change in use. Um, so the inter agency referral act when it was adopted was intended. uh I think based on what I've seen to require sister agencies actually to come before the plan commission and explain. For example, why is the CTA buying land? Why is the park district buying land? What um, it's incredibly broad. Uh, if if the if if land that was a city college is being changed now to something else. Uh it's really not. Um it's not limited to zoning actions. It's uh, it just is this very broad capturing of anything happening with publicly owned land. So Tim, can you treat me like a 2-year-old and give me some understanding of how this reflected in real life. What what comes to, uh, plan commission today for plan commission. These items are bundled on the Omnibus, uh, which is the first item that is held. They are typically reviewed without discussion or approval and they are The, the body moves on to the substantive uh, uh, matters of the day. I know that you yourself sit on plan commission. You've never seen a presentation related to 1 of these of these items before because there has never been a presentation related to 1 of these items before it is, uh, a very perfunctory proforma, uh, function of the body that, that, that, as Lisa said, does not need to exist right now. The level of review is already performed by you yourselves and and your colleagues at city council that that's a good explanation. Thank you and it won't change anything about the way zoning is reviewed. Correct. Thank you and just a quick question. How how much time do you think this could potentially save in terms of like Expediting? Some of the uh, this process just as as, you know, just a rough estimate. Uh, if for the meetings themselves for plan commission, specifically, a minimal amount of time for the meeting itself, but in terms of Staff time, you know, a staff person has to still do everything. That needs to be done for these presentations. In terms of writing, the reports, filling out the forms, all of that those things. So, you know, for any given item. 2 hours or so per item. And if there's 5 to 10 a month, you know, 10 to 20 hours per month in staff time, that could be used on other better things and In your Wards. Thank you, Allah. So, were you talking about almond? Uh, chairman I think he wanted to know how how much less time. How much time would would 30 days the developer say in doing this? Um, well this I guess for for plan commission. This is City only stuff. So we would save a couple of weeks uh, 2 to we have to go to plan commission before we go to city council. So worst case we save our best up. Biggest upside, we save a month. If we don't hit the cycle right? For uh CDC, we would definitively say 1 to 2 months with this action. So let's say people 30 to 60 days. Yes, elderman out and and it's good that we can cut down on that amount of time. But the reality is everything that happens beforehand before it gets, there could take 6 to 9 months, we need to figure out how to cut down the land sale process period. Yeah uh you agree. I agree. Sorry. Yes, so yeah, this is just the beginning and I think, yeah, we'll definitely look forward to continue to maximize and make sure that our time, uh, is spent, you know, the things that matter the most. I think this is not taking away from any automatic, um, uh, review. But there certainly paperwork and I think, um, looking forward with all the committee members are looking at ways to expedite that before even, it gets to this point. Outdoor Plaza in the third world, Frank, uh, crisak from the Department of planning. And development is present to testify on behalf of this ordinance, Frank, good morning, uh, chairman and members of the housing and real estate committee. Uh, for the record, my name is Frank and I'm with the Department of Planning and Development. I'm a coordinator of economic development in these small business, uh, development Bureau and today, I'm presenting on and requesting approval for the proposed city-owned land lease ordinances for 3 public outdoor plazas or pops, um and before I get into each 1 um I'd like to note that for each 3 of these plazas. We currently have temporary, um, occupancy Authority, through 2 FM. Um, each lease would be for a 3-year term with a clause in the lease that states the city can terminate it, um, for any reason with a minimum 90-day notice and then also each lease is $1 for the term So just a brief overview of the, um, pop program. For those of you who aren't uh familiar, um, this is an arpa funded program and pop projects are led by Community Partners who were chosen through a competitive RFP process. Um projects engaged a team of local artists designers Landscape Architects, general contractors. Um, the designs for each of these are unique to the needs of each neighborhood. Um, and plans have become more ambitious as time has gone on, uh, local artists are instrumental to the design of each Pop, um, and we like to try and tell the story of each Community through this art and then importantly ongoing programming, um, for the community for people of all ages, um, is integral to the success of each Plaza. So we have um 11 Pops that have opened since 2022 and 10 Community areas throughout the city and primarily on the South and West sides. So the uh first, um, ordinance, I would like to talk about is Southside sanctuary. So this um Plaza is located at 4702, um, through 04 South, um, King Drive, it is in ward 3. Um, Alderman Pat Dowell who was in support. Um, it's in the Grand Boulevard community area, um, in the Southeast planning region of the city in the 47th in King Tiff. So for site context, it's on the southwest corner of 47th. And King, it's roughly 13,000 uh square feet. And um, I also have the pins on here too. If anybody's interested. uh, so zoning context, uh, as all of these are its city-owned vacant land and this particular parcel is B15 zoning. so the, um, Uh, delegate Agency, for this project, is Ivy Inc. Um which actually stands for, I am your village. Uh, Project summary part of um part of our pop program. Uh, this transformed along vacant city-owned lot um into a plaza that features an immersive outdoor, Green Space, uh performance stage skating ramps. Um, grassy nles outdoor classrooms, Landscaping, public art, um, and actually a market space for local vendors. Um, so 712,000, um, was awarded through the Chicago, Chicago recovery plan and the total project cost is just under $900,000. Um, and then project timeline, we released an RFP in March 2022. Contract was awarded in september 2022 and this Plaza opened um in August of this year. Um, some more details, um the creation of this Plaza supported more than 35 jobs internships and Workforce Development opportunities. um, in the fields of architecture and construction, um, for more than 75 girls. In the, uh, polished Pebbles program, the uh, property features repurposed trees from the urban Prairie Waldorf School, which recently closed a 10-ft fall 10-ft tall, art fence, uh, free Wi-Fi, uh, performance stage, and then um, recreational multi-use, uh, ramps and Ledges for wheelbase activities, like, uh, skateboarding roller skating and bicycling and then um, environmental remediation, uh, was con an assessment was conducted and Remediation was completed. so, this is just a picture of the site, um, before And then this was taken actually the day of the ribbon cutting. Um, so this is what the site looks like after. and I believe, Yeah. Um, so that is it for this particular um Plaza. I'm happy to answer any questions. Any question. Um, and I think this is a wonderful idea to reuse uh, for public space or some they can lot that has been sitting. In the 16th word uh Frank also is here for the Department of planning to share, uh, more details on this project. Frank, Uh yes, thank you. So this is um, the plaza called Englewood, break room. So sorry overview for this. 1 is 1534 West 63rd Street um, W 16. Um, Alderman, Stephanie Coleman is in support, it's in the west Englewood community area the 63rd Ashland Tiff. Um just barely in the Southeast uh planning region and this also is for a 3-year lease. So this Plaza is about 10,000 square feet. Um it's on the northwest corner of 63rd and Justine And this property is b32 zoning. The, uh, delegate agency is teamwork Englewood. Um, so this Plaza is primarily for community events. Uh, retail and local business use um for entrepreneurs. Um teamwork Englewood received a $500,000, um, CRP Grant from us, um, for a total of dollars for this project. And, um, They, uh, we released the RFP on March in March 2022. They were awarded a contract in september 2022 and this Plaza opened in June 2023. so, uh, Englewood break room has a semi-permanent stage that allows for um small festivals performances and other community events, um, it has 5 shipping containers, uh, that allow for heating cooling and covered space for uh, vendors resources and um, actually for serving food during events and programs. Um, and these shipping containers really maximize, the versatility of the plaza. There is playground equipment, um, for school age children, In the plaza. And then, um, my favorite part of the plaza is it includes an ice rink in the winter, um, which allows for for the space to be used frequently to support the community, um, throughout the winter months. And, um, I think it's a really great unique part of it. Um, and then environmental assessment was conducted and Remediation was completed. So here is what the site looked like before. and, This is what it looks like after. So the picture on the left, I really wanted to get 1 with the ice rink in it. Um, the programming that they they do around the ice rink is called The Miracle on 63rd Street, and then the picture on the right is from the summer. Number 8, um, ordinance 2024.001, 12571 lease agreement with Stan's Family, Foundation, for use of the city owned property at 3907 39213939 and 3941 West Roosevelt Road, as a public outdoor Plaza in the 24th Frank again for another of these great proposals, it seems like thank you. I'll I'll be out of here soon. I promise. Um, So, yes, this is for the stains Family Foundation, um, for 3 separate plazas as part of a larger project. The address is um, as chairman said, our 3907 3921 and then then 3939 and 3941, uh, West Roosevelt Ward, um, Ward 24, Um, Alderman Scott is in support. Um, the north Lawndale community area. It is in the midwest Tiff and the West uh, planning region. And this would also be for a 3 year land lease. so these are 4 City owned Parcels uh 2 of the parcels are on the southwest corner of Roosevelt and Springfield and then the other 2 which make up 1. Larger Plaza are on the, uh, southwest corner of Roosevelt and Harding. Uh, these are all b32 zoning. And the applicant is the stains Family Foundation, so um, a little bit different than the other plazas. This is a completely privately funded project um, where they will transform these 4 Parcels into 3 Plaza, community events Recreation. Um, and art as part of their other various Redevelopment projects in North Lawndale, so they're not um requesting any city funding for this. Uh, their estimated total project cost is 3.6 million. Uh, they broke ground in Spring of this year. They are hoping to have a grand preview block party. Um for the project this month uh with a tentative ribbon cutting date of December 2024. So, uh the these pops will include walking paths, seating, um, plantings fencing, large very large scale, art sculptures a stained glass Pavilion, tables, and a sculptural play playground equipment. Uh, the project will engage with local use and offer, various Community activations events, um, and programming. Uh so the 3907 West Roosevelt um Plaza is named simply the plaza, the 3921 Roosevelt Plaza is named soulflower and the 3939 41, West Roosevelt, um, Plaza is named fantasy Park. Uh, the stains Foundation has retained Lamar Johnson, collaborative collaborative as the designer for the project and whiten company as the project manager. Um and as I mentioned, this is completely privately funded. funded. And the city's role is simply in an advisory capacity, environmental remediation on the site is required, which consists of an in, in, installing an engineered barrier, And the plans, the health and safety plan for the barrier were submitted and improved and Remediation is in progress. So here is the, uh, Previous site condition for the 3907. West, Roosevelt lot. And then here is a rendering of the plaza. Um so this is 1 that um features the stained glass Pavilion, large, those are just mock-ups. Um, kind of placeholders of large-scale public art and walking paths, um, and also a basketball court and mural art. Here is the site condition for 3921 West Roosevelt. And then so this is soulflower. So it's a play on it essentially. a sunflower field with, um, Crushed blue stone uh gravel walking paths uh fencing. And um large scale artwork. And then finally, the 3939 uh, 41 West Roosevelt lot. And this is fantasy Park. Um, so this is the 1 that uh, incorporates incorporates kind of um artistic uh, playground equipment. Um so this 1 is primarily focused on a local youth. Excuse me 1 second please. Can we ask the audience to please? We can we remove people from the from the audience, please? I mean, these are really impactful to change the the curve appeal or or who's that Rogue. So I'm grateful and proud. That's a great project. Um this question that I have a question for the Department of planning, all these these 3, lots are at least. What are the lease agreements? What are the amounts of money would give us some specifics on that? Oh yeah. So they're all 4 or 3 years and it's a dollar for the term. And then, as I mentioned, uh, before 2, there's a clause in each of them, that states, um, the city can terminate the lease at any time. For any reason. Um, given a minimum 90-day notice, Um, okay. Um, I think we we we can enforce, the reverter Clause we just have to have to do it. Um, Nelson, do you have anything to add? What do you need Nelson to enforce, the reverto, for the record and Nelson Chong Department planning. Um, I do think that the what we've been doing is proactively, um, at our closing for the, either the open space or side jars. We walk through all these applicants, we actually do a, uh, pretty long, uh, PowerPoint slide presentation, explaining the requirements of the program conditions that have deed. And we also go through the, uh, the 3 main, um, Street and stand violations of a ticket. So we talked about the uh, uh uh, fencing requirement. We talk about the, uh, uh, keeping debris off the ground and also with the, uh, uh, amount the grass. Uh, we do want to, uh, prep these, uh, applicants as much as possible, we have been and, um, uh, we happened, just over the past 2 months, we've actually been going out and doing site, inspections of the ones, we've recently been doing Doing for the most part. Most people have been Lisa, there are more recent land sales have been maintained these sites as far as going back to your question about. That's not my question. I do sounds good. Yeah. But what do you need to? Enforce. The vertical Clause when people fail to do what they say, they're gonna do. What what's the what's the policy? Yeah, that that does happen. Uh, there are those uh few bad apples that don't um don't do any improvements. What we have been doing uh just right now. In terms of of, uh, practices that we uh, we reach back out to the individuals or the entities who have bought bought the properties. We send them, uh, notification letters in terms of a deficiencies of uh violations. And we actually follow up with them, if not, I think what we and we get to the part where we we need to work more on is the actual legal. Action to take properties bad. That is a court action that these to do. Um, we're trying not to do that unless we really have to, but as in The Last 5 Years, have you have you taken back any property? We have not taken bad properties. We have, uh, gone to step of actually, sending certified letters to owners and getting them to comply and people will happen. Uh responding to that. Um, I'm not going to say that is That's not foolproof way to handle it but uh um, uh, we are working on on a path to figure out well legally what, how to take these properties back? Okay, you're gonna I'm gonna ask you that a budget so come up with a better answer. Okay. Thank you. We'll definitely work, maybe with the Department of Housing on this answer, uh, but but, but your mutual, and that same vein, um, you noted that after 5 years based on the, uh, requirement for the open, open space. That they cannot sell for 5 years. How do you guys enforce that as well? The same. It's written into the deed right? The uh again Nelson Strong again from the Department planning, the deed that we convey. The appropriate actually stipulates that the uh they cannot transfer the proper 5 years. If they do that, then becomes a uh a cumbersome property and uh it it stays on it legally from the title action. So if any buyer wants to buy the property from them um they'll be noticed noticed and then we reach out to the potential buyer as well too. And then inform the applicant is the encumbrance the amount of the is the 10% value or is the encumbrance the full value. Now, it's only, you know, the the device the violation becomes a essentially, is a violation of the deed. So it's, ah, it's not a monetary um, um encumbrance So it's not a it's not a monetary. So with the what's the what would stop me from selling before 5 years at a profit? Well, if you try to sell the property, uh, if I stole the, if we, um, Department, sold a, um, an Open Space Project to you to you, um, the deed restrictions in place. So if you try to sell the property to someone else, um and uh and you're pulling up the title work and and you want to build construction on it. The, the Restriction put in place says that you are supposed to improve that a lot, whatever that is and you hold on for 5 years. So if you're trying to do any financing or anything on a property that will be flagged as a, uh, as a problem with the title company. Okay? So it, it just stops, it stops the sale, right? It does work, it does work. So we we've had situations where, um, where people um um try to sell a property and it gets flagged down and then the what happens is that the buyer or the potential future buyer uh Hops and and stops and says they can't do that, okay?
